This Law determines legal, organizational, social and economic basis of ensuring activities in the field of physical culture and sport in the Republic of Tajikistan.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) the sports agent - the physical person or legal entity performing activities by means of making of legal and other acts on assistance in employment of athletes or trainers in professional sports club;

2) association of physical culture and sport - the union of independent athletes, sports federations, legal entities, state bodies and other public organizations of physical culture and sport;

3) the program of sports preparation - the document developed for training of athletes according to requirements of state standards of sports preparation, establishing the main directions and conditions of sports preparation at each stage;

4) the Olympic Games - sports competitions in individual and team Olympic sports which are carried out time in four years among athletes of five continents of the world under patronage of the International Olympic Committee;

5) the Paralympic Games - the international winter and summer competitions which are held time in four years among disabled athletes with defeat of the musculoskeletal device and organs of vision under patronage of the International Paralympic Committee;

6) Deaflympics - the international winter and summer competitions held among disabled athletes with damage of organs of hearing;

7) sport - one of fundamentals of physical culture, the sphere of social activities which developed in the form of special practice of training of the person for competitions and to competitive activities for the purpose of achievement of sports results;

8) elite sport - the part of sport directed to achievement by athletes or teams of high sports results at official republican sports competitions and official international sports competitions;

9) student's sport - the part of sport directed to physical training and physical training of the studying educational institutions of average and higher education for the purpose of their participation in sports and sporting events;

10) professional sport - the part of sport directed to achievement of high sports results and profit earning by physical persons or legal entities;

11) sport for children and young people - the part of sport directed to physical culture, sports training of children and juniors and their participation in sports competitions;

12) school sport - the part of sport directed to physical training and physical training of the studying educational institutions of the general education and their preparation for participation in sports and sporting events;

13) mass sport - the part of sport directed to physical training, improvement and physical development of citizens, and also participation in sports and mass sporting events;

14) the athlete - the physical person which is systematically doing the chosen type or sports, constantly improving the sports skills and participating in sporting events;

15) the athlete-instructor - the active sportsman, having high sports rates, team member of the district, city, regional and republican organization of sports preparation, the owner of sports rank receiving the salary or other remuneration according to the activities;

16) the professional athlete - physical person for which professional sports are core activity, the salary and other remunerations for preparation for sports competitions, the participation in them which signed the employment contract (contract) in the field of professional sport and receiving in accordance with the established procedure and the shown results;

17) the high-class athlete - the athlete who is the member of national team of the Republic of Tajikistan on certain sport, participating at sports competitions for the purpose of achievement of high sports results and (or) having sports rank is not lower than "The Master of Sports of the Republic of Tajikistan";

18) athletes are disabled people - the physical persons having the violation of health with permanent disorder of functions of organism caused by diseases, injuries, physical and intellectual defects which leads to life activity restriction, systematically doing available type or sports and speaking at sporting events;

19) certain sport national team of the Republic of Tajikistan (further - national team of the Republic of Tajikistan) groups of athletes, and also their trainer, medical and other specialists in the field of physical culture and sport who perform preparation also participate in the international sports competitions on behalf of the Republic of Tajikistan;

20) the sports judge - the physical person who had special training and received the corresponding qualification category, authorized by the organizer of sports competition for ensuring compliance with rules of sport and regulations on sports competition;

21) sports reserve - the athletes having the potential for achievement of high sports results, having sports training for the purpose of their inclusion in structure of sports national teams, including certain sports national teams of the Republic of Tajikistan;

22) sports construction - the real estate intended for holding sports and improving actions or sporting events;

23) sports club and the hall - commercial or non-profit organization, irrespective of legal form and pattern of ownership, departmental subordination and industry accessory, created by the physical and (or) legal entity, intended for holding sports, sporting and (or) improving events;

24) professional sports club - the legal entity who is the participant of professional sports competition or declared in the procedure established by the organizer of professional sports competition participation in such competition;

25) rules of sport - the commonly accepted regulations on certain sport based on which sports competitions are held;

26) professional sports league - the legal entity created in the forms of business established by the legislation of the Republic of Tajikistan whose main objectives of activities are the organization and (or) holding professional sports competitions;

27) authorized state body in the field of physical culture and sport - the central executive body of the government of the Republic of Tajikistan performing the special executive and other functions established in the field of physical culture and sport;

28) sports disqualification - the sports sanction in the form of discharge of the athlete, the trainer, the sports judge, the sports doctor and other workers and specialists of the sphere of physical culture and sport from participation in sports competitions or from labor professional activity according to the procedure, established by regulatory legal acts and statutory rules;

29) the trainer - the physical person having industry secondary vocational professional education or higher education which holds sports and sporting events performs physical training and sports training of athletes for sports competitions, and also directs their competitive activities for achievement of sports results;

30) sports competition - the competition (match) held among athletes or teams on different types of sport (sports disciplines) for the purpose of identification of the best competitor (match), held by the approved provision of sports competition;

31) professional sports competition - sports team sports competitions, participation in whom is directed to income acquisition, and one of conditions of the admission of the athlete to which availability at it employment relationships with the relevant professional sports club is. In other sports professional sports competitions are sports competitions, participation in which is directed to income acquisition and which are determined as those by their organizers according to provisions of sports competitions;

32) doping control - planning process of performing diagnostics, capture of test for the analysis and work with them, the laboratory analysis, the decision after check and provision of addresses;

33) not Olympic sport - the sport which did not enter the program of the Olympic and Paralympic Games, gained broad development in world sports community and headed by the international sports federation;

34) national sport - the sport which is historically developing in the territory of the Republic of Tajikistan in the form of competitive activities, having welfare focus;

35) the Olympic sport - the sport which entered the program of the Olympic Games, recognized by the International Olympic Committee according to the Olympic Charter;

36) technical and applied sports - sports which provide special training of the athlete for competitions using technical means;
