The government of the Republic of Kazakhstan DECIDES:

1. Bring in the order of the Government of the Republic of Kazakhstan of May 12, 2011 No. 506 "About approval of Rules of use of airspace of the Republic of Kazakhstan and modification of the order of the Government of the Republic of Kazakhstan of December 31, 2010 No. 1525 and about recognition voided some decisions of the Government of the Republic of Kazakhstan" the following changes and amendments:

in the Rules of use of airspace of the Republic of Kazakhstan approved by the specified resolution:

state Item 17-1 in the following edition:

"17-1. For each object (polygon, shooting range, training center, pit, the field, the mine, section) on which the works connected with production of firing practice, missiles launches, explosive works, uncontrollable aerostats are carried out (except for the uncontrollable probes or aerostats specified in the subitem 5) of Item 22 of these rules) and other activities posing safety hazard of flights, the owner or the body responsible for operation of object are performed, the agreement on interaction with the Department of Internal Affairs centers in which coordination measures between the Department of Internal Affairs center and body of Department of Internal Affairs for time of the beginning and cessation of work, establishment of vertical and horizontal borders and measure for interaction are specified is drafted. The agreement on interaction is approved with the Department of Internal Affairs center and body of Department of Internal Affairs around which responsibility there is object, and affirms the responsible person (head) of object.

In case of approval of the agreement on interaction the body of Department of Internal Affairs can initiate change of vertical and horizontal borders, and also the action period for the purpose of safety in case of production of flights.";

"17-2. In case of accomplishment of flights of the unmanned aerial vehicles, except as specified, specified in Item 82-1 of these rules, the operator or the owner of the unmanned aerial vehicle in the Department of Internal Affairs center and body of Department of Internal Affairs in which zone of responsibility accomplishment of flights is planned provide information on production of flights of the unmanned aerial vehicle for review in the form determined by the service regulations of unmanned aerial vehicles in airspace of the Republic of Kazakhstan approved by authorized body in the field of civil aviation.";

For establishment of the danger area, zone of restriction of flights users of airspace for the benefit of whom the specified danger area, zone of restriction of flights are established not later than 9 days before commissioning of the danger area, zone of restriction of flights, represent to HZ of the Department of Internal Affairs request for establishment of the danger area, zone of restriction of flights with indication of its vertical and horizontal borders, the period of action and nature of the performed activities.

22. Danger areas are established for the benefit of the following types of activity, connected with:

1) work with ammunition on objects of their storage;

2) implementation of scientific research in the atmosphere;

3) electromagnetic radiations;

4) light radiations;

5) areas of start of uncontrollable aerostats or probes (except for uncontrollable aerostats or probes which are classified as lungs, according to Item 83-1 of these rules);

6) zones of fall of the separated parts of carrier rockets.";

"24. If activities for the benefit of which the danger area, zone of restriction of flights are established have no permanent character, action of the danger area, zones of restriction of flights is limited to the temporary period.

Data on activities in danger areas, zones of restriction of the flights limited to the temporary period are led up by means of the notice of NOTAM according to the types of messages on movement of aircrafts and production of the activities connected with use of airspace provided by appendix 3 to these rules.";

"30-1. Flights of unmanned aerial vehicles in airspace over borderland are performed according to item 4 of article 33 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft".";

"32. Flights of aircrafts over settlements out of the established schemes (routes) for the purpose of implementation of actions for rescue of life and to health protection of people, suppression and disclosure of crimes, and also accomplishment of aviation works, parachute jumps, flights of unmanned aerial vehicles, raising of fastened aerostats are carried out at height providing realization of the specified actions with safety of accomplishment of flights by the organizer of such flights.

Approval of accomplishment of flights of civil aircrafts over settlements out of the established schemes (routes), except for the flights connected with actions for rescue of life and health protection of people, suppression and disclosure of crimes, and also the flights which are carried out within holding security actions of Service of the state protection of the Republic of Kazakhstan, and issue of permissions to flights of the state aircrafts and unmanned aerial vehicles of all types of aircraft is made by the Department of Internal Affairs centers in case of the representation of flight plan according to the procedure provided by Section 4 of these rules.

The Department of Internal Affairs centers in case of approval of such flights:

1) is excluded by entrances to prohibited areas and zones of restriction, except for flights on which special permissions of authorized body in the field of the state aircraft are issued;

2) is checked by availability of necessary approvals, stipulated in Item 82-2 these rules.

During security actions flights of aircrafts over settlements are approved with bodies of homeland security and Service of the state protection of the Republic of Kazakhstan.";

state Item 47 in the following edition:

"47. The HZ of the Department of Internal Affairs performs planning of use of airspace based on all provided plans of flights for operational air traffic, flight plans of unmanned aerial vehicles, and also requests for use of airspace.";

"58. Flight plan is represented for receipt of permission to use of airspace of classes A, B, C, D and E, and also when using airspace of class G for the purpose of the notification of bodies of servicing of air traffic (air traffic control) and flight and information servicing at the request of the operator.
