About amnesty in connection with the 30th anniversary of declaration of independence of the Republic of Moldova
Based on Item р) Article 66 and Item o) parts (3) article 72 of the Constitution of the Republic of Moldova
The Parliament adopts this organic law.
Art. 1. - (1) This law is applied it is caused and it is exclusive concerning suspects, persons accused and defendants, and also concerning the convicts who are positively characterized in term of imprisonment, in the period of probation or probation period and psychologically estimated as representing average or small risk of recurrence if these persons fall under action of provisions of Articles 2-5, 7, 8.
(2) the Issue of application of amnesty concerning convicts is resolved by the special commissions on application of amnesty concerning convicts (further - the special commissions) created for this purpose under each organization which is carrying out punishment from representatives of National penitentiary administration and National inspectorate for probation. The issue of application of amnesty concerning convicts for making of extremely serious crime is resolved by the special commission consisting of representatives of the Ministry of Justice, National penitentiary administration, National inspectorate for probation, the General inspectorate of police, and also the representative of the Prosecutor General's Office. The special commissions are created by the order of the Minister of Justice and act on the basis of the standard provision approved by the order of the Minister of Justice.
(The organization performing punishment brings 3) based on decisions of the special commission in competent degrees of jurisdiction of idea of application of provisions of this law.
(4) the Question of application of amnesty concerning suspects, persons accused is solved the prosecutor on stages of criminal prosecution, and concerning defendants - degree of jurisdiction at stage of legal proceedings.
