About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:
1. In Article 532:
consider single part part (1) and in it word "Ministry of Foreign Affairs of the Republic of Moldova", shall be replaced with words "Ministry of Foreign Affairs and European Integration";
add Article with part (2) the following content:
"(2) Requests about the international legal assistance according to the Rome Statute of the International Criminal Court ratified by the Law No. 212/2010, and the related documents go through the Ministry of Foreign Affairs and European Integration through diplomatic channels.".
2. Part (Article 533 to add 1) with Item 8-2) of the following content:
"8-2) actions requested by the International Criminal Court according to the Rome Statute of the International Criminal Court ratified by the Law No. 212/2010;".
3. Add the code with Article 549-3 of the following content:
"Article 549-3. Transfer of person to the order of the International Criminal Court
(1) Requests of the International Criminal Court about transfer of person to its order are reviewed by Appeal chamber Chisinau in the procedure established for extradition. The decision of appellate instance is subject to execution from the date of removal, but can be appealed in cassation procedure in the Highest trial chamber in 10-day time from the date of its removal according to provisions of the paragraph 2 of part 2 of Chapter IV of the Section II of the Special part.
(2) both citizens of the Republic of Moldova, and persons to whom the status of the refugee or the right to shelter are provided can be transferred To the order of the International Criminal Court.
(3) Person which is the subject of request of the International Criminal Court is given to the court order if follows from its request and the related documents that consideration of crime is within the competence of the International Criminal Court.
