About introduction of amendments to the Family code of Ukraine concerning increase in the minimum size of the alimony levied on the child from other family members and relatives and introduction of the minimum size of temporary government assistance to children whose parents evade from payment of the alimony
The Verkhovna Rada of Ukraine DECIDES:
I. Bring in the Family code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2002, Art. No. No. 21-22, 135) the following changes:
1. The eighth Article 181 to state part in the following edition:
"8. If the residence or stay of parents is unknown, or they evade from payment of the alimony, or have no opportunity to contain the child, to the child the temporary government assistance taking into account financial position of family in which the child, but at least 50 percent of subsistence minimum for the child of the corresponding age is brought up is appointed. Payment of temporary government assistance is made at the expense of means of the Government budget of Ukraine".
2. The second Article 272 to lay out part such edition:
"2. If the claim is made not to all obliged persons, and only to some of them, the size of the alimony is determined taking into account obligation of all obliged persons to provide deduction. At the same time the cumulative size of the alimony which is subject to collection on one child shall be necessary and sufficient for ensuring harmonious development of the child and there cannot be less than 50 percent of subsistence minimum for the child of the corresponding age.
The minimum recommended cumulative size of the alimony which is subject to collection from other family members and relatives on the child constitutes the size of subsistence minimum for the child of the corresponding age and can be awarded by court in case of sufficiency of earnings (income) of the payer of the alimony".
