Questions of some payments to the military personnel, faces of the private and the commanding structure, to police and their families during action of warlike situation

In pursuance of Presidential decrees of Ukraine of February 24, 2022 No. 64 "About introduction of warlike situation in Ukraine" and No. 69 "About general mobilization", article 9-2 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" and paragraphs two - the eighth Item 2 of the Section II "Final and transitional provisions" of the Law of Ukraine of June 28, 2023 No. 3161-IX "About introduction of amendments to some laws of Ukraine of rather single questions connected with passing of military service during action of warlike situation" the Cabinet of Ministers of Ukraine decides:

1. Determine that for warlike situation on emergency situations, faces of the commanding structure of Management of special transactions of National anti-corruption bureau and police officers extra fee in the amount up to 30000 hryvnias in proportion per month is paid to faces of the private and the commanding structure of Public service, and from them which are directly involved in fighting or provide those implementation of actions for homeland security and defense, repulse and control of the armed aggression, being directly in areas of their maintaining (implementation), in particular in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor, during implementation of the specified actions, the size of such extra fee increases to 100000 hryvnias per month in proportion to time of participation in such actions and actions. To faces of the private and the commanding structure of the territorial (interregional) paramilitary forces of the Public criminal and executive service attracted by the Commander-in-chief of Armed Forces in structure of operational and strategic group of the corresponding group of troops to direct participation in fighting or ensuring implementation of actions for homeland security and defense, repulse and control of the armed aggression, being directly in areas of carrying out military (fighting) operations during implementation of the specified actions, extra fee in the amount up to 100000 hryvnias per month in proportion to time of participation in such actions and actions is paid.

To company strong point inclusive, and also in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor in areas of conducting the military (fighting) operations, for each 30 days which are (totally estimated) of accomplishment of such tasks in addition to the extra fee determined by paragraph one of this Item one-time remuneration in the amount of 70000 hryvnias is paid to the police officers who is carrying out fighting (special) tasks during conducting fighting (special) actions on the line of fighting collision with the opponent at distance of accomplishment of fighting (special) tasks by military unit (division, in particular summary) of the first echelon of defense or approach (counterattack, counterattack).

To persons specified in paragraph one of this Item who carry out fighting (special) tasks as a part of body of military management, the headquarters of group of troops (forces) or the headquarters of tactical group in control center of operational and strategic group of troops inclusive (including out of areas of conducting fighting (military) actions) which exercises operational (fighting) management of the military units and divisions conducting military (fighting) operations on the line of fighting collision at distance of accomplishment of fighting (special) tasks by military unit (the division in particular built) of the first echelon of defense or approach (counterattack, counterattack), the size of extra fee can be increased in accordance with the terms and the sizes determined by the Ministry of Internal Affairs, but no more than to 50000 hryvnias per month is pro rata to time of accomplishment of such tasks.

1-1. Determine that for warlike situation:

the serviceman of Armed Forces, Security services, Services of foreign intelligence, Head department of investigation of the Ministry of Defence, National guard, the State Border Service, Management of the state protection, Public service of special communication and information security, the Public special service of transport (further - the military personnel) which are directly involved in fighting or implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine, being directly in areas of their implementation, in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor, extra fee in the amount of 100 000 hryvnias per month in proportion to time of participation in such actions and actions is monthly paid. In case of accomplishment of fighting (special) tasks when conducting fighting (special) actions on the line of fighting collision with the opponent at distance of accomplishment of fighting (special) tasks by military unit (division, in particular summary) of the first echelon of defense or approach (counterattack, counterattack) to company strong point inclusive, and also in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor in areas of conducting military (fighting) operations and in the territory of the opponent one-time remuneration in the amount of 70000 hryvnias for each 30 days (totally estimated) accomplishment such tasks is in addition paid to the military personnel;

the serviceman who is carrying out fighting (special) tasks as a part of body of military management, the headquarters of group of troops (forces) or the headquarters of tactical group in control center of operational and strategic group of troops inclusive and also as a part of command and the headquarters of military unit (summary division) (including out of areas of conducting fighting (military) actions) exercising operational (fighting) management of military units and divisions conduct military (fighting) operations on the line of fighting collision at distance of accomplishment of fighting (special) tasks by military unit (division, in particular summary) of the first echelon of defense or approach (counterattack, counterattack), extra fee in the amount of 50000 hryvnias per month in proportion to time of accomplishment of such tasks in accordance with the terms, determined by the Ministry of Defence is paid;

extra fee in the amount of 30000 hryvnias per month in proportion to time of accomplishment of such tasks is monthly paid to the military personnel performing fighting (special) tasks during implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine.

Leading and instructor teachers in teaching military units (training centers, educational divisions), extra fee in the amount of 15000 to 30000 hryvnias taking into account their level of training (qualification) in proportion to time of implementation of preparation and personnel training per month according to the list of positions leading and the instructor teachers in teaching military units (training centers, educational divisions) approved by heads of the relevant ministries and state bodies is monthly paid to the military personnel holding positions.

The size of extra fee on categories of positions leading and instructor teachers in teaching military units (training centers, educational divisions) is established according to appendix.

To the military personnel who in connection with the wound (contusion, injury or mutilation) connected with protection of the Homeland is acknowledged as the military-medical commission it is limited suitable for military service or unsuitable to military service with review in 6-12 months and are enlisted in the order of the corresponding commanders, within two months from the date of transfer in the order (without time management of stay in leave and on treatment) cash cover (without extra fee) on the last post in full is paid. After stay in the order more than two months and before the end of stay in the order by such serviceman the salary on military rank, length-of-service allowance and extra fee in the amount of 20100 hryvnias is monthly paid.

Remuneration for features of service is monthly paid to the military personnel of compulsory military service during warlike situation (the special period) in the amount of 6000 hryvnias it is pro rata to service time per month.

Remuneration for features of service (training) is monthly paid to cadets of the highest military educational institutions, institutions of higher education with specific conditions of training, and also institutions of higher education which incorporate military institutes, faculties of military preparation, department of military preparation, department of military preparation, organizations of professional prehigher military education which before transfer on training were not on military service or underwent compulsory military service during warlike situation (the special period) in the amount of 2350 hryvnias it is pro rata to stay time on service (training) per month.

1-2. Payment of extra fee and one-time remuneration is performed based on orders of commanders (chiefs).

Charge and tax payment, charges, fees in the relevant budgets is performed according to the procedure, determined by the legislation as for cash cover.

According to orders on payment of extra fee in the amount of 100000 hryvnias such orders join persons specified in Items 1 and 1-1, including such, which:

in connection with wound (contusion, injury, the mutilation) connected with protection of the Homeland, and for police officers and faces of the private and the commanding structure of service of civil protection - with participation in fighting or ensuring implementation of actions for homeland security and defense, repulse and control of the armed aggression, being directly in areas of their maintaining (implementation), in particular in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor, during implementation of the specified actions, are on hospitalization in healthcare institutions (including foreign), including movement time from one medical institution of health care in another, or are on vacation for treatment after wound (contusion, injury or mutilation) in connection with receipt of severe wound according to the conclusion (resolution) military-medical (medical and expert, medical) commissions;

are captured (except those which voluntarily were given in captivity) or are hostages, and also are interned to the neutral states or it is unknown are absent (in case the specified events took place both before introduction of warlike situation, and after its introduction);

died (died) as a result of the introduction of warlike situation got later of the wound (contusion, injury or mutilation) connected with protection of the Homeland (payment is performed for all month in which person died (died).

2. To persons having the right to payment of the one-time monetary assistance in case of death of persons specified in Items 1-1-2 of this resolution, and also their death owing to the wound (contusion, injury, injuries) sustained in the period of warlike situation during protection of the Homeland, participation in fighting or ensuring implementation of actions for homeland security and defense, repulse and control of the armed aggression, being directly in areas of their maintaining (implementation), in particular in the territory of Ukraine which is temporarily occupied by the Russian Federation, in the territory between line items of forces of defense and line items of troops of the state aggressor, during implementation of the specified actions not later than in one year after wound (contusion, injury, mutilation), the one-time money allowance in the amount of 15 million hryvnias is paid.

The extent of the one-time monetary assistance in case of death (death) of the serviceman in the period of warlike situation in case of execution of obligations of military service by it cannot constitute less than 15 million hryvnias.

The size of the one-time money allowance paid in other cases provided by subitems 2 and 3 of Item 2 of article 16 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" is determined according to the paragraph the second the subitem "an" of Item 1 of article 16-2 of the specified law.

In case of availability of the personal order of persons specified in Items 1-1-2 of this resolution (except faces of the commanding structure of Management of special transactions of National anti-corruption bureau), on case of death (death) about payment of the one-time monetary assistance to person (persons) the size of share of such persons as a percentage is for choice determined. The amount of the help of persons having the right to it except citizens of the Russian Federation or the Republic of Belarus and persons who are constantly living in the territories of these countries, persons condemned for high treason, kollaboratsionny activities, complicity to the state aggressor is determined according to the size of the shares specified at the personal order, as a percentage.

In case of lack of the personal order or in the presence of not covered the personal order of share of the extent of the one-time monetary assistance persons determined in part four of article 118-1 of the Code of civil protection of Ukraine, part four of article 98 of the Law of Ukraine "About National police" and item 4 of article 16-1 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" except citizens of the Russian Federation or the Republic of Belarus and persons who are constantly living in the territories of these countries, persons condemned for high treason, kollaboratsionny activities, complicity to the state aggressor in equal shares have the right to appointment and receipt of the one-time monetary assistance (its share).

Irrespective of contents of the personal order juvenile, minor, full age disabled children, the disabled widow (widower) and disabled parents of the died (died) person in the amount of 50 percent of share which would belong to each of them in case of appointment and payment of the one-time monetary assistance in the absence of the personal order have the right to appointment and receipt of the one-time monetary assistance.

Payment of the one-time monetary assistance provided in this Item is performed to persons specified at the personal order of the died persons specified in Items 1-1-2 of this resolution or to persons specified in part four of article 118-1 of the Code of civil protection of Ukraine, part four of article 98 of the Law of Ukraine "About National police" and item 4 of article 16-1 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" taking into account provisions of paragraphs of the fourth and fifth this Item.

Persons having the right to the one-time monetary assistance provided by this resolution can realize it within three years from the date of origin at them such right. Day of emergence of such right is the date specified in the death certificate of person specified in Items 1-1-2 of this resolution which death happened in the period of warlike situation or the death of whom came owing to the reasons specified in paragraph one of this Item not later than in one year after wound (contusions, injuries, mutilations).

Distribution of shares of the one-time monetary assistance in case of refusal of one of persons specified at the personal order or refusal of one of persons specified in part four of article 118-1 of the Code of civil protection of Ukraine, part four of article 98 of the Law of Ukraine "About National police" and item 4 of article 16-1 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families" of receipt of the one-time monetary assistance and also in case one of such persons in three-year time from the date of emergence of the right to the help did not exercise the right to the one-time monetary assistance, is performed according to requirements of article 118-3 of the Code of civil protection of Ukraine, article 100 of the Law of Ukraine "About National police" and article 16-3 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families".

The refusal of appointment and receipt of the one-time monetary assistance on behalf of juvenile, minor children of the died (died) person, and also incapacitated persons and persons whose civil capacity to act is limited, having the right to appointment and receipt of the one-time monetary assistance is not allowed.

Persons having the right to the one-time monetary assistance can refuse its appointment and obtaining by filing of application, authenticity of the signature on which makes sure notarially.

If after purpose of the one-time monetary assistance other persons address for its obtaining, the issue of distribution of the amount of such help is resolved by mutual consent or judicially between such persons.

The state bodies specified in Items 1-1-2 of this resolution have the right to obtain information from state bodies which are owners (managers, holders, owners, administrators, etc.) the information (automated), information and communication, communication and help systems, registers and databanks, concerning persons having the right to the one-time monetary assistance according to provisions of part five of article 118-3 of the Code of civil protection of Ukraine, part six of article 100 of the Law of Ukraine "About National police" and Item 7 of article 16-3 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families".

Payment of the one-time monetary assistance is not performed in cases, stipulated in Article 118-4 Codes of civil protection of Ukraine, by article 101 of the Law of Ukraine "About National police" and article 16-4 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families".

The one-time money allowance is paid to person by money transfer by authorized body into the account in organization of bank of the public sector specified by the receiver in the statement.

If persons specified at the personal order of the died persons specified in Items 1-1-2 of this resolution or persons specified in part four of article 118-1 of the Code of civil protection of Ukraine, part four of article 98 of the Law of Ukraine "About National police" and item 4 of article 16-1 of the Law of Ukraine "About social and legal protection of the military personnel and members of their families", at the same time have the right to the one-time monetary assistance provided by this resolution, and the one-time monetary assistance or compensation payment established by other acts of the legislation one of such payments for their choice is performed.

2-1. Determine that the ministries and state bodies in coordination with the Ministry of Finance and the Ministry of Economics determine:

procedure, conditions and the amount of payment of extra fee to persons specified in Item 1 of this resolution;

features of payment of extra fee and remuneration for features of service (training) during warlike situation (the special period) in persons specified in Item 1-1 of this resolution, and extra fee to persons specified in Item 1-2 of this resolution including regarding establishment of the list of the fighting (special) tasks and actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine for implementation of such payment, taking into account the tasks assigned to Armed Forces, Security service, Service of foreign intelligence, Head department of investigation of the Ministry of Defence, National guard, the State Border Service, Management of the state protection, Public service of special communication and information security, the Public special service of transport;

procedure and conditions of payment of the one-time monetary assistance and one-time remuneration.

3. To the Ministry of Finance to handle issue of increase in expenses to the corresponding managers of budgetary funds for ensuring implementation of this resolution.

4. Stop before the termination or cancellation of warlike situation action of the paragraph of third Item 1 of the resolution of the Cabinet of Ministers of Ukraine of January 20, 2016 No. 18 "Some questions of cash cover of the military personnel, faces of the private and the commanding structure and police officers" (The Official Bulletin of Ukraine, 2016, No. 6, the Art. 316).

5. This resolution becomes effective from the date of its publication and is applied since February 24, 2022.
