About introduction of amendments to the Law on the electric power No. 107/2016

The Parliament adopts this organic law.

Art. I. - In the Law on the electric power No. 107/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 193-203, 413), with subsequent changes, to make the following changes:

1. Add the law with preamble of the following content:

"This law shifts Article 1-16, 18, 22-38, 40-43, and also provisions of appendix I to the Directive 2009/72/EU of the European Parliament and Council of July 13, 2009 about general rules of the domestic market of the electric power and cancellation of the Directive 2003/54/EU published in the Official magazine of the European Union by L 211 of August 14, 2009; Article 1-3, 13-17, 19 and 21, and also provisions of appendix I to Regulations (EU) 714/2009 European Parliament and Council of July 13, 2009 about conditions of access to networks for cross-border exchange of the electric power and cancellation of Regulations (EU) of 1228/2003, European Union published in the Official magazine of L 211 of August 14, 2009; The Directive 2005/89/EC of the European Parliament and Council of January 18, 2006 about measures for safety of supply with the electric power and investments into the infrastructure published in the Official magazine of the European Union by L 33 of February 4, 2006".

2. Part (Article 7 to add 2) with Items j) - m) the following content:

"j) in case of establishment of regulated rates for service in transmission of electricity and rates for connection considers the payments performed by the system operator to the owner of networks of electricity transmission for right to use of electricity transmission by networks, including its components which were recovered or replaced at the expense of the owner of networks of electricity transmission provided that such works were performed according to Regulations on planning, approval and implementation of investments in electric utility sector;
