About settlement of activities of participants of the market of the non-bank financial services, non-bank financial groups, participants of the payment market, the collection companies and legal entities who obtained the license for provision to banks of services in collection

According to Articles 7, 15, 55-1 Law of Ukraine "About the National Bank of Ukraine", to Articles 19, 21, 28 Laws of Ukraine "About financial services and state regulation of the markets of financial services", article 36 of the Law of Ukraine "About insurance", article 26 of the Law of Ukraine "About credit unions", to Articles 9, 10 and 12 Laws of Ukraine "About payment systems and money transfer in Ukraine", to the Law of Ukraine "About legal regime of warlike situation", to the Law of Ukraine of February 24, 2022 No. 2102-IX "About approval of the Presidential decree of Ukraine "About introduction of warlike situation in Ukraine"", to the Presidential decree of Ukraine of February 24, 2022 No. 64/2022 "About introduction of warlike situation in Ukraine", for the purpose of safety and financial stability of financial system, prevention of the crisis phenomena during introduction of warlike situation and minimization of negative impact of effects of military aggression of the Russian Federation against Ukraine the Board of the National Bank of Ukraine DECIDES:

1. Requirements of this resolution extend on:

1) suppliers of financial, accompanying services (except banks);

2) non-bank financial groups, supervision on the consolidated basis of which is exercised by the National Bank of Ukraine (further - National Bank);

3) operators of payment systems, technological operators of payment services, members of payment service providers, suppliers of limited payment services;

4) the operators of mail service having the right to perform activities for trade in currency values;

5) the legal entities who obtained the license of National Bank for provision to banks of services on the collection/license for implementation of transactions with cash;

6) the commercial agents involved to provision of financial payment services.

2. Requirements of this resolution extend to banks, branches of foreign banks (further - banks), public authorities, local government bodies which are payment service providers, in the cases determined by this resolution.

3. Persons specified in Item 1 of this resolution are exempted from submission of documents, information that in pursuance of requirements of the resolution of Board of the National Bank of Ukraine of December 29, 2023 No. 199 "About approval of the Regulations on authorization of suppliers of financial services and condition of implementation by them of activities for provision of financial services" (with changes) (further - the Resolution No. 199) and Regulations on authorization of suppliers of financial services and condition of the implementation by them of activities for provision of financial services approved by the resolution of Board of the National Bank of Ukraine of December 29, 2023 No. 199 (with changes) (further - Regulations on authorization), had obligation their tax, but taking into account requirements of this resolution as of March 20, 2025 did not give to National Bank, in case of simultaneous observance of the following conditions:

1) (further - EGR) as of March 20, 2025 settlements of the territories specified in Items 2, 3 Sections I were the location of such persons according to the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming or the Section II of the List of the territories in which are conducted fighting or temporarily occupied by the Russian Federation, the Ministry of development of communities and the territories of Ukraine approved by the order of February 28, 2025 No. 376, registered in the Ministry of Justice of Ukraine on March 11, 2025 at No. 380/43786 (was conducted) (with changes) (further - the List);

2) rather corresponding territory specified in the subitem 1 of Item 3 of this resolution dates of completion of fighting actions / dates of completion of temporary occupation as of March 20, 2025 are not determined.

4. Persons specified in Item 1 of this resolution whose location are settlements of the territories specified in Items 2, 3 Sections I of the List taking into account the features established in Items 20-1, 20-12 of this resolution within three months after:

1) determination in Items 2, 3 Sections I of the List of date of completion of fighting;

2) changes of the location on the settlement of the territory which is not included in the List or on the settlement of the territory included in the list concerning which date of completion of fighting actions / temporary occupation of such territory is determined shall file the documents and/or information specified in in case of the bases for giving:

Regulations on authorization;

the regulatory legal acts of National Bank specified in appendix 1 to this resolution.

5. No. 191 is excluded according to the Resolution of Board of the National Bank of Ukraine of 28.12.2024

6. Requirements of subitems 1, 3-5 Items 8, of Item 20-14 of this resolution do not extend to persons specified in Item 1 of this resolution who after entry into force of the Law of Ukraine of July 27, 2022 "About modification of some legal acts of Ukraine concerning features of activities of the financial sector in connection with introduction of warlike situation in Ukraine" (further - the Law) changed No. 2463-IX the location and settlements of the territories specified in Items 2, 3 Sections I and the Section II of the List provided that concerning the corresponding territory dates of completion of fighting actions / dates of completion of temporary occupation are not determined (further - persons which changed the location) became their new location.

7. Requirements of Item 6 of this resolution do not extend to persons specified in Item 1 of this resolution who changed the location before date of inclusion of the territory of the respective settlement in Items 2, 3 Section I, the Section II of the List.
