About modification of the Section XII "Final and transitional provisions" of the Law of Ukraine "About judicial system and the status of judges" concerning ensuring steady functioning of judicial authority in absence period of authorized structure of the Supreme council of justice

The Verkhovna Rada of Ukraine decides:

I. "About judicial system and the status of judges" (Sheets of the Verkhovna Rada of Ukraine, 2016, No. 31, of Art. 545 with subsequent changes) to add the Section XII "Final and transitional provisions" of the Law of Ukraine with Items 55 and 56 of the following content:

"55. Temporarily to determine that during action of emergency or warlike situation and within 30 days after day of its cancellation (termination) and on condition of absence of authorized structure of the Supreme council of the justice determined by article 131 of the Constitution of Ukraine:

1) the number of judges in court (except the Supreme Court) is determined by Public judicial administration of Ukraine taking into account judicial loading and in the expense limits determined in the Government budget of Ukraine on content of courts and compensation of judges;

2) the decision on formation of territorial administrations of Public judicial administration of Ukraine and determination of their quantity is accepted by Public judicial administration of Ukraine without approval of the Supreme council of justice;

3) the Service of judicial protection is accountable and under control to Public judicial administration of Ukraine;

4) the Chairman of Service of judicial protection, his deputies are appointed to positions without carrying out tender and dismissed by the Chairman of Public judicial administration of Ukraine.

56. To temporarily determine that during action of emergency or warlike situation and within 30 days after day of its cancellation (termination) and on condition of absence of authorized structure of the Supreme council of the justice determined by article 131 of the Constitution of Ukraine, the Chairman of the Supreme Court or person performing powers of the Chairman of the Supreme Court performs the following powers:
