This resolution partially states Regulations of the Commission (EU) the No. 589/2008 of June 23, 2008 establishing detailed rules of application of Regulations of Council (EU) No. 1234/2007 about market standards for eggs, published in the Official magazine of the European Union by L 163 of June 24, 2008 with the last amendments made by the delegated Regulations of the Commission (EU) 2017/2168 of September 20, 2017; Regulations of the Commission (EU) No. 2073/2005 of November 15, 2005 about microbiological criteria for foodstuff published in the Official magazine of the European Union by L 338 of December 22, 2005 with the last changes made by Regulations of the Commission (EU) 2019/229 of February 7, 2019; Regulations of the Commission (EU) the No. 543/2008 of June 16, 2008 establishing detailed rules of application of Regulations of Council (EU) No. 1234/2007 concerning standards of sale of fowl, published in the Official magazine of the European Union by L 157 of June 17, 2008 with the last changes made by Regulations (EU) No. 1308/2013 of the European parliament and Council of December 17, 2013.
According to part (2) article 34 of the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, 2019, Art. No. 59-65, 120), with subsequent changes, and part (3) article 37 of the Law No. 279/2017 on informing consumers concerning foodstuff (The official monitor of the Republic of Moldova, 2018, Art. No. 7-17 54), with subsequent changes, DECIDES: the Government
1. In Rules of retail trade by separate types food and the nonfoods approved by the Order of the Government No. 65/2001 (Official monitor of the Republic of Moldova, 2001, Art. No. 11-13, 101), with subsequent changes, to recognize Chapters II and III invalid.
2. In appendices No. 1 and No. 4 to the Order of the Government No. 1209/2007 about provision of services of public catering (The official monitor of the Republic of Moldova, 2007, Art. No. 180-183 1281), with subsequent changes, makes the following changes:
1) in appendix No. 1:
a) in Item 6 the text "permitted by sanitary bodies," to exclude;
b) in Item 11 of the word "the hygienic veterinary certificate" shall be replaced with words "veterinary sanitary certificate";
c) in Item 16 of the word "also approve them with territorial subdivisions of the National agency on safety of foodstuff" to exclude;
d) add Item 18 with the text "In the menu the operator of the sphere of the food industry shall specify any ingredient or technological additive which cause the allergy or intolerance used in production or preparation of foodstuff and which still are present at ready-made product, even at the modified form according to Items b) and c) part (1) article 8 of the Law No. 279/2017 on informing consumers concerning foodstuff. In case of creation of the menu it is necessary to consider provisions of Article 19 and technical specifications provided in appendix 1 to the Law No. 279/2017 on informing consumers concerning foodstuff.";
e) add Item 21 with the text "Process charts of preparation of dishes affirm the chef/administrator of the company.";
f) add Item 23 with the following paragraph:
"sale on the Internet";
g) to state paragraph two of Item 28 in the following edition:
"In catering establishments, in culinary departments of the shops and the companies performing sale on the Internet, the cash register receipt is issued to the consumer in case of payment, and in the companies where customer service is performed through waiters, payment for the ordered products is made based on the account shown by the waiter and the cash register receipt according to article 10 of the Law No. 105/2003 on consumer protection is issued.";
2) in appendix No. 4:
a) in Item 3 of the word "sanitary authorizations" shall be replaced with words "veterinary and sanitary authorization", and in Item 102 of the word "sanitary and hygienic authorization" to replace with the text "veterinary and sanitary authorization, net";
b) add item 4 with the concepts "catering service" and "perishable foodstuff" of the following content:
"catering service - the service including delivery of the food and/or drinks made or unprepared for consumption by the person, together with the accompanying services necessary for possibility of their consumption outside commercial zone of catering establishment;
perishable foodstuff - microbiological unstable foodstuff with short expiration date which needs to be stored and realized in case of certain temperature condition for preserving its harmlessness and qualities.";
c) in Item 33 the offer second to exclude;
d) in Item 55 the text "which correspond to the existing regulations" to replace with the text "to which the documents certifying their harmlessness and quality according to the Law No. 306/2018 on safety of foodstuff are attached";
e) state Item 86 in the following edition:
"86. Catering establishments shall be equipped with the refrigerating rooms partitioned so that to exclude infection of raw materials, thermally processed culinary products or semi-ready products / semifinished products, or absorption of smells of foodstuff which allocate characteristic smells. They shall be divided and be stored according to the storage temperature, storage duration and quantity of the products which are subject to storage with possibility of control and record of temperature.";
f) add with Item 86-1 of the following content:
