About introduction of amendments to the Criminal code of Ukraine concerning responsibility for illegal use of the humanitarian assistance

The Verkhovna Rada of Ukraine decides:

1. The criminal code of Ukraine (2001, Art. No. 25-26, 131) to add sheets of the Verkhovna Rada of Ukraine with Article 201-2 of the following content:

"Article 201-2. Illegal use for the purpose of profit earning of the humanitarian assistance, charitable gifts or free aid

1. Sales of goods (objects) of the humanitarian aid or use of charitable gifts, free aid or the conclusion of other transactions on the order such property, for the purpose of profit earning, made in considerable size, -

are punished by penalty from two to three thousand free minima of the income of citizens or corrective works for a period of up to two years, or restriction of freedom for a period of up to four years.

2. The same actions made repeatedly or by previous concert by group of persons or the official with use of official position or in large size, -

are punished by imprisonment for a period of three up to five years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years and with confiscation of property.

3. The actions provided by part one or the second this Article, made by organized group or in especially large size or during emergency or warlike situation, -

are punished by imprisonment for a period of five up to seven years with deprivation of the right to hold certain positions or to be engaged in certain activities for a period of up to three years and with confiscation of property.
