About introduction of amendments to the Law of Ukraine "About lease of the state-owned and utility property"

The Verkhovna Rada of Ukraine decides:

1. The Section "Final and Transitional Provisions" of the Law of Ukraine "About lease of the state-owned and utility property" (2020, No. 4, the Art. 25) to add sheets of the Verkhovna Rada of Ukraine with Items 6-1 and 6-2 of the following content:

"6-1. During action of the warlike situation Cabinet of Ministers of Ukraine can determine other rules of transfer to lease of the state-owned and utility property, than those which are provided by this Law, in particular relatively:

terms of provision of consent to inclusion of object of lease in one of lists;

the starting rent in cases if information on residual book value of object of lease is less than 10 percent of original book value of object of lease;

need of implementation of assessment of object of lease for the purposes of its transfer to lease to the lessees provided by paragraph one of part one of article 15 of this Law;

terms of holding the auction and approval of the protocol of results of auction;

need and terms of loading by the lessor of the lease agreement and delivery-acceptance certificate in UTS;

possibilities of signing of documents by means of the qualified digital signature and the list of such documents;

lease treaty extensions, in particular about introduction of possibility of automatic prolongation of lease agreements which effective period comes to an end during action of warlike situation, for a period of up to the termination or cancellation and for four months after the termination or cancellation of warlike situation;

terminations by the lessee of the lease agreement;

non-use of the separate transfer restrictions of property in the sublease provided by paragraphs to the ninth and tenth part one of Article 3 and article 22 of this Law, at the same time effective period of the agreement of the sublease signed according to this Article cannot exceed the effective period of warlike situation increased for four months;
