Some questions of procedure for conducting medico-social examination for action of warlike situation in the territory of Ukraine

According to article 12-1 of the Law of Ukraine "About legal regime of warlike situation", to the Presidential decree of Ukraine of February 24, 2022 "About introduction of warlike situation in Ukraine" the Cabinet of Ministers of Ukraine decides No. 64:

1. Determine that for action of warlike situation in the territory of Ukraine and within six months after its termination or cancellation:

1) if person addressing for disability establishment cannot arrive to survey to medico-social commission of experts, such commission can make the decision on disability establishment in absentia based on the direction of the medical and advisory commission;

2) Crimean republican, regional, central city in Kiev and Sevastopol, city, interdistrict and district medico-social commissions of experts perform the functions with ensuring exterritoriality and provide conducting medico-social examination in the direction by the medical and advisory commission irrespective of place of registration, residence or stay of person who addresses for disability establishment.

2. Determine that for action of warlike situation in the territory of Ukraine:

1) Item 5 of the Regulations on procedure, conditions and criteria of the establishment of disability approved by the resolution of the Cabinet of Ministers of Ukraine of December 3, 2009 No. 1317 "Questions of medico-social examination" (The Official Bulletin of Ukraine, 2009 No. 95, the Art. 3265), is not applied;
