About modification and amendments in the Code of civil procedure of Turkmenistan

Part the fifth Article 20 to state 1) in the following edition:

"5. Hearing of the case in the closed judicial session is conducted with observance of all regulations of civil legal proceedings. During the closed judicial session maintaining audio-both videos and use of system of digital video conference is not allowed. Court decrees in all cases are proclaimed publicly.";

Part the second Article 45 to add 2) with the paragraph of the following content:

"Explanations of the parties and the third parties, testimonies of witnesses, consultation (explanations) of the expert and specialist can be received by use of system of digital video conference according to Article 172-1 of this Code.";

To add 3) after Article 172 with Article of the following content:

"Article 172-1. Participation in process by use of system of digital video conference

1. In the presence in courts of technical capabilities for implementation of digital video conference, at the request of the parties or at the initiative of court, persons participating in case their representatives, and also witnesses, experts, specialists, translators can participate in judicial session by use of system of digital video conference. Participation of specified persons in judicial session by use of system of digital video conference shall be carried out only in court house.

2. The judge takes out determination about carrying out judicial session by use of system of digital video conference. The copy of determination without delay goes to the relevant court for the organization of carrying out judicial session by use of system of digital video conference.
