RESOLUTION OF THE MINISTRY OF JUSTICE OF THE REPUBLIC OF BELARUS

About change of the resolution of the Ministry of Justice of the Republic of Belarus of April 7, 2017 No. 67

Based on paragraph one of subitem 6.35 of Item 6 and part one of Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:

1. Bring in the Instruction on enforcement proceeding approved by the resolution of the Ministry of Justice of the Republic of Belarus of April 7, 2017 No. 67, the following changes:

to add the name of Chapter 30 after the words "securities" with words ", cryptocurrency";

add the Instruction with Item 195-1 of the following content:

"195-1. For the purpose of the address of collection on the cryptocurrency belonging to the debtor, the legal executive issues the decree on seizure of cryptocurrency and if necessary transfers it to virtual purse of body of forced execution or the subject of trade, the specialized organization about what issues the decree on transfer of cryptocurrency.

Transfer on realization of cryptocurrency is made without establishment of its cost. The realization of cryptocurrency is enabled by the subject of the trade specialized by the organization on contractual basis through the operator of cryptoplatform and (or) the operator of exchange of cryptocurrencies from their consent. The cost of the realized cryptocurrency constitutes actual amount of the money enlisted into the account of body of forced execution.

In case of refusal the operator of cryptoplatform and (or) the operator of exchange of cryptocurrencies to realize the arrested cryptocurrency arrest is removed, other restrictions (encumbrances) are cancelled based on the resolution of the legal executive and the cryptocurrency returns to the debtor.

Unrealized according to the executive document on confiscation of property of the debtor, on the address of property of the debtor to the income of the state otherwise the cryptocurrency to the debtor does not return.";
