About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Criminal code of the Republic of Moldova No. 985/2002 (repeated publication: The official monitor of the Republic of Moldova, 2009, Art. No. 72-74, 195), with subsequent changes to make the following changes:
1. In Item d) parts (1) Article 77 of the word "social, national, racial or religious hatred;" to replace with the word "prejudices;".
2. To add Chapter XIII of the General part with Articles 134-21 and 134-22 of the following content:
"Article 134-21. Motives of prejudice
(1) motives of prejudice are understood as prejudiced judgments of person who made act, the races based on signs, skin colors, ethnic origin, national or social origin, nationality, floor, sort, language, religion or religious beliefs, political views, limited opportunities, sexual orientation, gender identity, the state of health, age, civil status irrespective of whether act concerning person having such protected characteristics concerning its property or related is made or concerning person providing support to persons having such protected characteristics or related at the same time such communication is real or it is perceived as real.
(2) Availability in profile of the victim of the certain protected characteristics in itself is not good cause for conclusion about crime execution based on prejudice.
(3) the Crime is considered committed based on prejudice irrespective of whether person who made act, fully or partially such motives was guided if there are also other motives.
Article 134-22. Person with limited opportunities
Person with limited opportunities is understood as person determined by that Law on social integration of persons with limited opportunities No. 60/2012.".
3. In Item e) parts (1) Article 135-1 of the word "types of sexual violence;" shall be replaced with words "violent acts of sexual nature;".
4. To add Chapter I of the Special part with Article 135-2 of the following content:
