About modification of the Criminal Procedure Code of Ukraine and other legal acts of Ukraine concerning cooperation with the International Criminal Court

The Verkhovna Rada of Ukraine decides:

I. Bring in the Criminal Procedure Code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88) the following changes:

1. In Article 183:

Part the second to add 1) with Item 7 of the following content:

"7) person concerning whom the request of the International Criminal Court for temporary arrest or for arrest and transfer according to the procedure and on the bases provided by the Section IX-2 of this Code arrived";

Part the fourth to add 2) with the paragraph the eighth the following content:

"The amount of pledge is not determined by consideration of question of application of measure of restraint in the form of detention according to Articles 629 - 631 of this Code".

2. The fourth Article 208 to add part with the paragraph third the following content:

"The authorized officer which performed detention of person which is searched by the International Criminal Court or concerning which the request of the International Criminal Court for temporary arrest or for arrest and transfer arrived also explains to person its right to agree to transfer to the International Criminal Court in the simplified procedure".

3. Add with the Section IX-2 of the following content:

"Section IX-2 of FEATURE of the COOPERATION WITH INTERNATIONAL CRIMINAL COURT

Note. Action of this Section extends only to cooperation with the International Criminal Court, for the purpose of distribution of its jurisdiction and/or affected persons (citizens of Ukraine, foreign citizens and stateless persons) who at the time of the crime execution falling under jurisdiction of the International Criminal Court were subordinated, for the purpose of implementation of the armed aggression against Ukraine, and/or based on decisions (orders, orders, etc.) of officials, military command, or public authorities of the Russian Federation or other country, performed aggression, or promoted its implementation against Ukraine.
