The Parliament adopts this organic law.
This law:
- partially shifts (Item (d) of Article 6, the last paragraph of part (2) Articles 80, part (2), part paragraph two (5) and part (6) Articles 81, Article 82, of part (2) and (3) Articles 90, Article 112, of part (1) and (2) Articles 113, part (1) articles 113a, Items (a) - (g) of part (2) Articles 114, part (2), Items (b) and (d) of part (4) articles 116a, Items (a) and (b) of part (1), parts (1a) and (4) Articles 168) Regulations of the European parliament and Council (EU) No. 1308/2013 of December 17, 2013 about creation of the general organization of the markets of agricultural products and about cancellation of regulations of Council (EEC) No. 922/72, (EEC) No. 234/79, (EU) No. 1037/2001 and (EU) No. 1234/2007, published in the Official magazine of the European Union by L 347 of December 20, 2013 CELEX: 32013R1308, with the subsequent changes made by Regulations of the European parliament and Council (EU) 2024/1143 of April 1, 2024;

- partially shifts (part (1) Articles 14, of part (1) - (3) Articles 20, Article 21, part (4) Articles 22) Executive regulations of the Commission (EU) 2018/274 of December 11, 2017 about establishment of rules of application of Regulations of the European parliament and Council (EU) No. 1308/2013 in the part concerning system of landing permits of vineyards, certification, register of import and export, obligatory declarations and notifications, about establishment of rules of application of Regulations of the European parliament and Council (EU) No. 1306/2013 in the part concerning the corresponding checks, and about cancellation of Executive regulations of the Commission (EU) 2015/561, published in the Official magazine of the European Union by L 58 of February 28, 2018, CELEX: 32018R0274, with the subsequent changes made by Executive regulations of the Commission (EU) 2022/2567 of October 13, 2022.
(1) This law determines legal, economic and social basis in the sector of grape pitomnikovodstvo, wine growing and winemaking, governs the relations in the field of production, conversion and realization of material for vegetative reproduction of grapes, commodity grapes of table and technical grades, grape wine and other products based on must and wine, the flavored grape and wine-making products, secondary products of winemaking and products received as a result of conversion of secondary products of winemaking.
(2) the Purpose of this law are:
a) protection of economic interests of the state and society in the sector of grape pitomnikovodstvo, wine growing and winemaking;
b) creation of proper conditions for production of commodity grapes, grape wine and other products based on must and wine;
c) ensuring proper functioning of the domestic market of grape and wine-making products and compliance to the international requirements in the grape and wine-making sector, taking measures of national policy in the field of quality;
d) strengthening of image of the Republic of Moldova as the countries with grape and wine-making traditions and increase in export of high-quality wines;
e) the prevention and suppression of falsification of grape wine, products based on must, products based on wine and the flavored grape and wine-making products;
f) increase in culture of consumption of wine, products based on wine and the flavored grape and wine-making products.
(3) Subjects of the relations regulated by this law are the physical persons and legal entities irrespective of type of property and form of business performing activities in the sector of grape pitomnikovodstvo, wine growing and winemaking.
(4) Operation of this law does not extend to the relations concerning:
a) productions and realization of ethyl alcohol and the alcoholic drinks made from other raw materials except grape;
b) productions of grape and wine-making products the population in the subsidiary farms for family (personal) consumption;
c) productions of grape vinegar.
(5) It is excluded.
(6) If international treaties in the sector of grape pitomnikovodstvo, wine growing and winemaking, one of the parties of which is the Republic of Moldova, other provisions than provided by this law are established, provisions of international treaties are applied. If other is not provided by international treaties, grape and wine-making products are made according to the processing methods of winemaking approved based on part (3) Articles 21, and also according to the processing methods of winemaking recommended and published by the International organization of wine growing and winemaking.
For the purpose of this law the following concepts are used:
vinogradarsky area - the geographical territory of cultivation of grapes which is characterized by certain ecological conditions, cultivation methods, the directions of use of grapes, acceptances of winemaking, specific traditions of cultivation and production;
the wine-making company – the physical person or legal entity acting at least in one of the following qualities: the producer of grape and wine-making products, the producer of wine, the processor or the operator of the barreling machine, the producer of products on the basis of wine;
the small producer of wine – producer of wine at which wine-making company wine in amount to 100 000 liters in wine-making year, based on annual average products for the last three consecutive wine-making years which owns at least than 1 hectare and no more than 20 hectares of vineyards and is legally independent of any other producer of wine is made;
grape planting - the agricultural site set with grapes;
production grape planting - the planting intended for receipt of the bunches used fresh for conversion and on drying;
commodity grape planting - grape planting by the square over 0,1 of hectare which products are intended for realization;
ecological wine growing – the system of cultivation providing development and preserving productive biological systems without use of synthetic chemicals;
table grades of grapes - grapes grades which clusters are used fresh after cleaning or storage;
technical grades of grapes - grapes grades which clusters are used for production of wine-making products;
universal grades of grapes - grapes grades which clusters are used as fresh, and for production of wine-making products;
seedless grades of grapes - table grades of grapes without seeds which clusters are used fresh and on drying;
grapes fresh - the grape berries used fresh or as wine-making raw materials, gathered in stage of consumer maturity, technological maturity or certain stage of overripening which after crushing or pressing by regular means can spontaneously enter spirit fermentation;
wine – the foodstuff received by exclusively complete or partial spirit fermentation of the fresh or refrigerated clusters pressed or not pressed or fresh grape must;
wine hybrid - the wine received from grapes of grades of hybrids of direct producers;
domestic wine - the wine made by physical persons in house conditions for family (personal) consumption;
winemaking product secondary – the remaining balance or product received in case of conversion of grapes and production of wine-making products;
