1) in Article 125.1:

a) the paragraph one of part three after the word "claims" to add with words ", this Article specified in part one,";

b) add with parts four - the sixth the following content:

"4. The claim to the resolution of the investigator, the investigator or the prosecutor who determines the sizes of the amounts which are subject to payment to the victim on covering of the expenses connected with remuneration payment to his representative is considered by the judge by rules, stipulated in Article the 125th of this Code, with the features established by this Article.

5. By consideration of the claim specified in part four of this Article, the judge checks legality and justification of the made decision, and also based on the arguments stated in the claim, need and correctness of expenses of the remuneration which was injured on payment to his representative.

6. By results of consideration of the claim specified in part four of this Article, the judge issues the decree containing one of the following decisions:

1) about grievance settlement and about recognition illegal the resolution specified in part four of this Article, determination of the sizes of the amounts which are subject to payment to the victim on covering of the expenses connected with remuneration payment to his representative taking into account the rate of inflation and their collection (compensation) according to Article 132 of this Code;

2) about leaving of the claim without satisfaction.";
