About features of lease of the state-owned and utility property in the period of warlike situation

According to the Law of Ukraine of April 1, 2022 "About introduction of amendments to the Law of Ukraine "About lease of the state-owned and utility property" the Cabinet of Ministers of Ukraine decides No. 2181-IX:

1. Determine that:

1) to physical persons and physical persons - the entrepreneurs who are called up or accepted for military service after introduction of warlike situation before its termination or cancellation charge of the hire charge of the state-owned and utility property from 1 date in which they were called or accepted on military service, on 1 date, the passing of military service following in three months after end date by them is not performed.

The fact of appeal or acceptance on military service and the fact of the end of passing of military service is confirmed by sending the adequate notice by the lessee to which the copy military and accounting or other document issued by competent authority that allows to establish start date and/or the ends of passing of military service by it is added.

The specified notification goes to the lessor according to the lease agreement of the state-owned or utility property in paper or electronic form.

To the lessees determined by paragraph one of this subitem, which:

reported about the beginning of passing of military service by them, but in three months after the termination or cancellation of warlike situation did not report about the termination or prolongation of passing of military service by them, the hire charge of the state-owned and utility property is charged in full from 1 date following after the third month after the termination or cancellation of warlike situation;

continue to use leased state-owned or utility property or provided it in use to other persons, the rent is charged in full from 1 date in which by results of control by the asset holder/lessor established fact of such use;
