About introduction of amendments to article 4 of the Law on standard price and procedure for purchase and sale of the earth No. 1308/1997

The Parliament adopts this organic law.

Single Article. - In article 4 of the Law on standard price and procedure for purchase and sale of the earth No. 1308/1997 (repeated publication: The official monitor of the Republic of Moldova, 2001, Art. No. 147-149, 1161), with subsequent changes to make the following changes:

in part (9-2) words "and also the designed, but not created forest belts", to exclude;

add Article with parts (9-3)-(9-9) of the following content:

"(9-3) For the purpose of assistance to process of consolidation of farmlands the parcels of land which are part of the field or part of this field, the forest belts busy designed, but not created, are sold at standard price of the land according to the rate specified in line item of the I appendix. Purchase and sale is performed based on the statement of the owner of the parcels of land which are subject to consolidation provided that owner of these parcels of land is the same person, and engineering procedures of processing (content) of adjacent lands are not broken.

(9-4) in case of sale of the parcel of land according to part provisions (9-3) buyer shall provide project development of the organization of the territory of agricultural holding which, in addition to other elements, shall include designing of forest belts on the square not smaller, than land area, provided by part (9-3), and to contain the reasoned reasons in case of reducing this area. Also the buyer shall provide landing of antierosion forest belts and carrying out hydrological improvement of the parcels of land according to the corresponding project developed by the public or private subject in the field. The buyer acquires the property right under resolutive condition in case of non-execution of the provided obligations.

(9-5) Body of local public authority provide that the obligations specified in part (9-4), and resolutive condition were provided by the purchase and sale agreement.
