About introduction of amendments to the Law of the Kyrgyz Republic "About subsoil"

Article 1.

Bring in the Law of the Kyrgyz Republic "About subsoil" (Sheets of Jogorku Kenesh of the Kyrgyz Republic, 2018, No. 5, the Art. 282) the following changes:

Article 4 to add 1) with Item 19-1 of the following content:

"19-1) historical costs - the total costs of last years incurred by the state on work on geological studying of the licensed area and geological investigation of fields, information on which is available in the State geological information fund;";

Article 20 to add 2) with Items 19 and 20 of the following content:

"19) acquisition at least 80 percent of goods and services in the territory of the Kyrgyz Republic, except for obligations according to the international treaties which became effective for the Kyrgyz Republic and also in cases when such goods or services are not made in the territory of the Kyrgyz Republic. At the same time in cases if the goods or services made in the territory of the Kyrgyz Republic do not cover fully need of the subsoil user, he has the right to buy missing amount outside the Kyrgyz Republic with the subsequent notification in writing of authorized state body on subsurface use;

20) employment at least 90 percent of workers from among citizens of the Kyrgyz Republic from general manpower ceiling, involved in works in the territory of the Kyrgyz Republic if other is not provided by regulations of the international treaties which became effective for the Kyrgyz Republic.";

Part 4 of Article 21 to state 3) in the following edition:

"4. Licenses for mineral right are prolonged according to the statement of the licensee in case of filing of application before the termination of effective period of the license.";

Article 22 to add 4) with part 9 of the following content:

"9. The procedure for determination, calculation and payment of cost of historical costs affirms the Cabinet of Ministers of the Kyrgyz Republic.";
