About introduction of amendments to some laws of Ukraine of rather first-priority measures of reforming of the sphere of town-planning activities

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. In article 17 of the Law of Ukraine "About investing activities" (Sheets of the Verkhovna Rada of Ukraine, 1991, No. 47, Art. 646; 2022, No. 6, Art. 44):

the second to state part in the following edition:

"The construction cost of objects (except highways public) which are constructed with attraction of budgetary funds, means of the state and utility companies, organizations and organizations, the loans granted under the state guarantees is determined based on estimate norms of Ukraine concerning pricing in construction according to article 7 of the Law of Ukraine "About the prices and pricing";

add with part three of the following content:

"The construction cost, reconstruction, repair and content of highways public is determined based on the techniques and rules approved by the central executive body which provides forming and realizes state policy in the field of road economy".

2. In the Law of Ukraine "About construction regulations" (Sheets of the Verkhovna Rada of Ukraine, 2010, No. 5, Art. 41; 2019, No. 46, Art. 304):

Part third of Article 9 to state 1) in the following edition:

"3. Creation and storage of funds of construction regulations are performed within the funds allocated from the government budget of Ukraine for financing of works on regulation in construction";

Part third of Article 10 to state 2) in the following edition:

"3. Contractors on regulation in construction are the basic organizations in construction. The regulations on the basic organization in construction approve the Cabinet of Ministers of Ukraine. The list of the basic organizations in construction and techniques of cost determination of works on regulation in construction establishes the central executive body which provides forming and realizes state policy in spheres of construction, town planning and architecture";

The Section III "Final provisions" to add 3) with Item 1-1 of the following content:

"1-1. During action of warlike situation and within 90 calendar days after its termination or cancellation subjects of regulation perform works on regulation in construction according to the Procedure approved by the Cabinet of Ministers of Ukraine. The working procedures in construction in the conditions of warlike situation determine features of development, approval, registration, modification of construction regulations, their introductions in force and recognitions by regulation their invalid or such which are not applied during action of warlike situation".

3. In the Law of Ukraine "On regulation of town-planning activities" (Sheets of the Verkhovna Rada of Ukraine, 2011, No. 34, Art. 343 with subsequent changes):

Part one of Article 1 to add 1) with Item 9-1 of the following content:

"9-1) program of complex recovery of area, the territories of territorial community (its part) (further - the program of complex recovery) - the regional or local program of recovery of the territories which determines the main space, town-planning and social and economic priorities of policy of recovery and include complex of actions for ensuring recovery of the territory of the respective area, the territory of territorial community (its part) which suffered as a result of the armed aggression against Ukraine or in which social and economic, infrastructure, ecological or other crisis phenomena are concentrated. The program of complex recovery does not belong to town-planning documentation";

Part third of Article 2 to state 2) in the following edition:

"3. Town-planning documentation is developed in electronic form which format is determined by the Cabinet of Ministers of Ukraine, on updated cartographic basis in digital form as sets of profile geospatial data in the state geodetic system of coordinates USK-2000 and single system of classification and coding of objects of town planning for forming of databases of the town-planning inventory";

Article 9 to add 3) with part three of the following content:

"3. The central executive body which provides forming and realizes state policy in the field of construction, town planning and architecture can be the customer of works on national standartization at the expense of means of the government budget.

For construction products which are provided in the market and are not covered or are not completely covered by national standards for the purposes of application of the Law of Ukraine "About provision of construction products in the market" other national standards on condition of quality assurance and stability of the indicators of construction products connected with its essential operational characteristics can be developed and be accepted. The list of national standards affirms the central executive body providing forming of state policy in the field of construction, town planning and architecture. The list of national standards is applied to the purposes of declaring of indicators of construction products and implementation of the state market supervision and state control of construction products.
