About modification of the Customs code of Ukraine about the administrative responsibility of citizens for customs offense

The Verkhovna Rada of Ukraine decides:

I. Bring in the Customs code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2012, Art. No. No. 44-48, 552) the following changes:

1. The fifth and sixth Article 366 to state parts in the following edition:

"5. The beginning of passing (journey by vehicles of private use) by the citizen by the channel designated by symbols of green color ("green channel") is declaring by making of actions by this citizen that the goods moved with it through customs border of Ukraine are not subject to written declaring, the taxation customs payments, do not fall under set by the legislation prohibitions and/or restrictions on import to customs area of Ukraine or export out of limits of this territory. Such declaring testifies to the facts having legal value.

6. Citizens who pass (pass vehicles of private use) through "green channel", are exempted from submission of the written customs declaration. Release from submission of the written customs declaration does not mean release from obligation of observance of procedure for movement of goods through customs border of Ukraine and from the administrative responsibility for customs offense, provided by this Code".

2. In part one of Article 369 of the word "from representation of holding actions of official control" shall be replaced with words "from holding actions of official control".

3. State Article 471 in the following edition:

"Article 471. Non declaration of the goods moved through customs border of Ukraine with citizens

1. Declaring of the currency values moved with citizens through customs border of Ukraine in the amount exceeding permitted by the legislation of Ukraine for their movement without written declaring -

involves imposing of penalty in the amount of 20 percent of the amount exceeding permitted by the legislation of Ukraine for movement of currency values without written declaring according to the official rate of the National Bank of Ukraine on the date of making of customs offense.
