Article 1

Bring in the Code of penal procedure of the Russian Federation (The Russian Federation Code, 2001, No. 52, Art. 4921; 2011, No. 1, Art. 45; 2018, No. 42, Art. 6375; 2021, No. 9, Art. 1462) following changes:

1) in Article 401.3:

a) in part two:

to add Item 1 after words of "garrison military court" with the words "provided that such judgment was subject of consideration of Appeal Court";

to add Item 2 after words of "Trial Court" with words "provided that such judgment was subject of consideration of Appeal Court";

b) third to add part with Item 1.1 of the following content:

"1. 1) sentence or other final judgment of the magistrate judge, district court, garrison military court; sentence or other final judgment of the Supreme Court of the republic, regional or regional court, court of the federal city, court of the autonomous region, court of the autonomous area, district (naval) military court which is taken out in course of production on criminal case as Trial Court - provided that such judgments were not subject of consideration of Appeal Court;";

2) in Article 401.14 part one:

a) add with Item 5.1 of the following content:

"5. 1) to cancel the judgment of cassation instance and to leave without change or to change sentence, determination or the court order and (or) the subsequent judgments;";

b) add Item 6 with the words "and (or) subsequent judgments";

3) in Article 412.11 part one:

a) add with Item 5.1 of the following content:

"5. 1) to cancel the judgment of cassation instance and to leave without change or to change sentence, determination or the court order and (or) the subsequent judgments;";

b) add Item 7 with the words "and (or) subsequent judgments".
