About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Law on obligatory civil liability insurance for the damage caused by vehicles, No. 414/2006 (repeated publication: The official monitor of the Republic of Moldova, 2016, Art. No. 44-48, 85), with subsequent changes to make the following changes:

1. In Article 8:

part (to state 1) in the following edition:

"(1) Compulsory third party car insurance is performed directly by the conclusion of the insurance contract between the owner or the user of the vehicle and the insurer owning license for activities in the field of compulsory third party car insurance who is constituted on paper either in the form of the electronic document or with use of electronic means, according to regulations of supervision body. If the agreement of compulsory third party car insurance is signed with use of any electronic means, and person did not imprison him the digital signature, it is supposed that the insurer, paying insurance premium, expressed the consent to the conclusion of the agreement.";

part (to state 4) in the following edition:

"(4) the Agreement of compulsory third party car insurance represents the single document consisting of the insurance policy AGO or the insurance certificate "Green card" issued by the insurer of motor vehicle liability according to the legislation with the autographic or strengthened qualified digital signature of the insurer. The insurance policy AGO and/or the insurance certificate "Green card" are issued on condition of complete payment of insurance premium.".

2. State Article 11 in the following edition:

"Article 11. Insurance premiums

(1) the Methodological calculation basis and applications of insurance premiums connected with internal and external compulsory third party car insurance is established by regulations of supervision body.

(2) Insurers and intermediaries in insurance shall provide on demand to the applicant of insurance information on the size of insurance premium, corrective coefficients, and also on bonus-malus applied to it to coefficient.".
