About modification of some regulations
The Parliament adopts this organic law.
Art. I. - In the Law on production and turnover of ethyl alcohol and alcoholic products No. 1100/2000 (repeated publication: The official monitor of the Republic of Moldova, 2010, Art. No. 98-99, 293), with subsequent changes to make the following changes:
1. Add Article 1 with concept of the following content:
"alcoholic energy drinks - the alcoholic products intended for consumption by the person, containing different combinations of carbohydrates with one or several substances: vitamins, minerals, caffeine, taurine, carnitine, guarany, the glucuronolactone and other connections having the stimulating effect on the central nervous system.".
2. Part (Article 5 to add 2) with Item j) the following content:
"j) production, realization, import and/or export of alcoholic energy drinks.".
Art. II. - Article 284 of the Code of the Republic of Moldova about offenses No. 218/2008 (repeated publication: 2017, Art. No. 78-84, 100), with subsequent changes to add the official monitor of the Republic of Moldova with part (2-1) following of content:
"(2-1) Production, realization, import or export of alcoholic energy drinks
attracts imposing of penalty on officials in the amount of 120 to 210 conventional units and on legal entities in the amount of 180 to 300 conventional units with deprivation or without deprivation in both cases of the right to perform certain activities for a period of 3 months till 1 year.".
Art. III. - Part (1) articles III of the Law on modification of some regulations No. 77/2022 (2022, 198) to state the official monitor of the Republic of Moldova to Art. No. 115-117, in the following edition:
"(1) This law becomes effective after 12 months from the date of publication in the Official monitor of the Republic of Moldova, except for provisions of Item 26 of article I and Item 1 of article II in the part concerning modification of Item and) parts (6) article 23 of the Law on grapes and wine No. 57/2006, which become effective since August 1, 2022.".
