About change of the laws concerning physical culture and sport

Article 1. Bring in the Labor code of the Republic of Belarus of July 26, 1999 the following changes:

1. Add the Code with Article 105-1 of the following content:

"Article 105-1. Guarantees for the workers who are participants of official sports and mass actions

Guarantees according to the procedure and on the conditions provided by legal acts in the field of physical culture and sport are provided to the workers who are participants of official sports and mass actions if participation in these actions does not belong to their labor duties.".

2. State Article 319 in the following edition:

"Article 319. Features of regulation of work of some employee categories

Features of regulation of work (competitive substitution of positions of employees, hourly pay of work, etc.) creative, the scientists, workers performing pedagogical activities in the field of physical culture and sport are established by the legislation.

Features of regulation of work of health workers are established by the republican state body pursuing state policy in the field of health care.

Features of regulation of work of athletes, trainers and other sports specialists of national teams of the Republic of Belarus (national teams on technical, aviation, military and applied and office and applied sports) in the part which is not settled by this Code are established by the President of the Republic of Belarus.

Article 2. Bring in the Law of the Republic of Belarus of January 4, 2014 No. 125-Z "About physical culture and sport" the following changes:

1. In Item 1 of Article 1:

2. State Article 2 in the following edition:

"Article 2. Legal regulation of the relations in the field of physical culture and sport

1. The relations in the field of physical culture and sport are governed by the legislation in the field of physical culture and sport, including the legislation on dope in sport, and also the international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.

2. The legislation in the field of physical culture and sport is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.

3. If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.".

3. In Article 5:

in the name of Article of the word "Safety rules" to replace with the word "Safety";

in Item 2 of the word "Council of Ministers of the Republic of Belarus" shall be replaced with words "The Ministry of Sport and tourism";

add Article with item 4 of the following content:

"4. The organizations and the individual entrepreneurs giving classes physical culture and sport taking into account the direction to activities for development of physical culture and sport and sports develop them and adopt the local legal acts regulating questions of safe training by physical culture and sport and also questions of carrying out with the physical persons playing physical culture and sport, instructing in training safety issues physical culture and sport, prevention and injury prevention, first-aid treatment in case of accidents.".

4. In item 4 of Article 7 of the word "violations of intelligence" shall be replaced with words "intellectual violations".

5. 1, of paragraphs of the first and second Item 2 of Article 8, of Item 2 of Article 17, of Item 2 of Article 34, of Item 3 of Article 46, of Item 3 of Article 52, of item 4 of Article 65-1 and item 4 of Article 66 of the word "Republic of Belarus" to exclude from Item.

6. In Item 2 of Article 8-1:

exclude the words "according to the legislation";

in Item 3:

after the words "by the form (types) of sport" to add Item with words "(types) of sport, and also federation (the unions, associations) included in the register of federations (the unions, associations) by the form, the cooperation agreements which are not included in the register of federations (the unions, associations) by the form (types) of sport, signed on development of type (types) of sport according to part two of item 4 of this Article";

add Article with Items 3-1 and 3-2 of the following content:

"3-1. The state bodies and the organizations exercising the state or public regulation and control in the field of physical culture and sport provide placement and maintenance in urgent condition in open access on the official sites on the global computer Internet of information connected with implementation of the state or public regulation and management in the field of physical culture and sport, except for information, distribution and (or) provision of which is limited or it is forbidden according to legal acts.

3-2. The organizations exercising public regulation and control in the field of physical culture and sport in addition to information specified in Item 31 of this Article shall place and support in urgent condition in open access on the official sites on the global computer Internet of the data on the governing bodies, the charters, other documents accepted by them within competence and connected with implementation of public regulation and management in the field of physical culture and sport.";
