About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:

1. Add Article 41 with Item 6-5) of the following content:

"6-5) permissions of completion of criminal prosecution in the absence of the person accused according to Article 291-1 provisions;".

2. Item 16) parts (articles 52 after words of "implementation of judicial examination" to add 1) with words ", completion of criminal prosecution in the absence of the person accused".

3. Add Article 64 with parts (3-2) and (4-2) following of content:

"(3-2) Suspect shall be on challenge of criminal prosecution authority and report about change of the residence.";

"(4-2) Suspect are informed in writing by criminal prosecution authority that in case of factual determination of evasion from criminal prosecution unreasonable absence for brining a charge does not interfere with completion of criminal prosecution and transfer of criminal case to degree of jurisdiction to its absence.".

4. In Article 66:

add Article with part (2-2) following of content:

"(2-2) Person accused are informed in writing by criminal prosecution authority that in case of factual determination of evasion from criminal prosecution unreasonable absence for brining a charge does not interfere with completion of criminal prosecution and transfer of criminal case to degree of jurisdiction to its absence.";

part (to add 5) with Item 1-1) of the following content:

"1-1) to report to criminal prosecution authority or degree of jurisdiction about change of the residence;".

5. In Article 69:

part (to add 1) with Item 14) of the following content:

"14) criminal procedure is conducted in the absence of the person accused, the defendant who evades from criminal prosecution or court.";
