Some questions of the state guarantee provided on debt obligations of private joint-stock company "The national energy company "Ukrenergo"
According to part one of Article 17 of the Budget code of Ukraine the Cabinet of Ministers of Ukraine decides:
1. Agree with the offer of the Department of Energy on confirmation of the state guarantee provided according to the resolution of the Cabinet of Ministers of Ukraine of October 11, 2021 to No. 1049 "About provision in 2021 to the state guarantee according to obligations of private joint-stock company "The national energy company "Ukrenergo" (The Official Bulletin of Ukraine, 2021, No. 82, of the Art. 5251) for ensuring accomplishment of debt obligations on the bonds of sustainable development issued and placed in November, 2021 (further - the state guarantee), by results of implementation of the transaction with debt obligations of private joint-stock company "The national energy company "Ukrenergo", arisen on the specified bonds, by modification of their conditions of placement (issue) (further - the transaction).
2. Determine that the state guarantee provides execution of debt obligations on the stipulated in Item 1 this resolution to bonds taking into account the changes defined by the agreement concerning, in particular, deferred settlement of bonds and payment of interest income for them and also possible increase in nominal amount of bonds in connection with payment deferral of interest income on them for 24 months on the amount which is not exceeding 120 million US dollars.
3. In case of increase in outstanding nominal amount of the stipulated in Item 1 this resolution of bonds by results of the performed transaction "The national energy company "Ukrenergo" to provide to the Ministry of Finance after receipt of the notification from private joint-stock company during preparation of the draft of the Government budget of Ukraine for the corresponding year accounting of increase in appropriately outstanding nominal amount of bonds within limiting amount of the debt guaranteed by the state.
