RESOLUTION OF THE PLENUM OF THE SUPREME COURT OF THE REPUBLIC OF BELARUS

About change of resolutions of the Plenum of the Supreme Court of the Republic of Belarus

Due to the change of the legislation the Plenum of the Supreme Court of the Republic of Belarus DECIDES:

1. Make changes to the following resolutions of the Plenum of the Supreme Court of the Republic of Belarus:

1.1. in the resolution of the Plenum of the Supreme Court of the Republic of Belarus of December 20, 2000 No. 9 "About court practice on cases on adoption (adoption)":

in preamble" (adoption) *" shall be replaced with words the word "(adoption) (further - adoption)";

state Item 1 in the following edition:

"1. Draw the attention of courts that cases on adoption are considered according to the procedure of special proceeding with observance of the rules established by paragraph 10 of Chapter 30 of the Code of civil procedure of the Republic of Belarus (further - GPK). At the same time it must be kept in mind that the relations on adoption are governed by the Code of the Republic of Belarus about scrap and family (further - KOBS), the Law of the Republic of Belarus of November 19, 1993 No. 2570-XII "About the child's rights", the Regulations on procedure for transfer of children on adoption (adoption) and control of living conditions and education of children in families of adoptive parents in the territory of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of February 28, 2006 No. 290, the Regulations on procedure for the international adoption (adoption) and establishment of the international guardianship, guardianship over children approved by the resolution of Council of Ministers of the Republic of Belarus of January 31, 2007 No. 122, and also other regulatory legal acts.

If the international treaty of the Republic of Belarus establishes other rules, than those which contain in the legislation on scrap and family of the Republic of Belarus then are applied rules of the international treaty (the p. 2 of Art. 237 of KOBS).
