About introduction of amendments to the Law on the National commission on the financial market No. 192/1998

The Parliament adopts this organic law.

Single Article. - In the Law on the National commission on the financial market No. 192/1998 (repeated publication: The official monitor of the Republic of Moldova, 2007, No. 117-126BIS), with subsequent changes to make the following changes:

1. In all text of the law of the word "individual act" and "Individual Act" to replace respectively with the words "administrative individual act" and "Administrative Individual Act" in the corresponding number and case.

2. In Article 5:

part (to add 2) with words: ", including in the context of the prevention and anti-money laundering and financing of terrorism, identification and investigation of violations in the field.";

"(3) National and international cooperation within competence of the National commission is performed on the principle of mutual assistance according to the legislation of the Republic of Moldova, on the basis of agreements on cooperation and international treaties which party is the Republic of Moldova.

(4) the National commission can sign agreements on cooperation, other than international agreements, and perform exchange of information with supervisory authorities of other states provided that guarantees of the state, trade and professional secrecy extend to the given information, at least equivalent established in the legislation of the Republic of Moldova. Agreements on cooperation shall provide that the transferred confidential information can be opened only from the direct consent of the National commission.

(5) Information coming from other state can be divulged only from the direct consent of body which provided it, and on circumstances only for the purpose of for which such consent was this.".

3. In part (1) Article 6:

in the prolog of Item h) words "annually paid" shall be replaced with words "paid with the frequency established by the National commission";
