About modification of some regulations
The Parliament adopts this organic law.
This law shifts part (1) Article 7 and part (3) Article 8 of the Directive 2014/42/EU of the European Parliament and Council of April 3, 2014 about freezing and the confiscation of means of making of crimes and the income from the crimes committed in the European Union, published in the Official magazine of the European Union by L 127 of April 29, 2014.
Art. I. - In the Code of penal procedure of the Republic of Moldova No. 122/2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 248-251, 699), with subsequent changes to make the following changes:
1. To state Item 20-1) of Article 6 in the following edition:
"20-1) parallel financial investigation - set of actions for criminal prosecution and the special search events performed for collection of the proofs concerning the suspect, the person accused, the civil defendant, the defendant or the convict, its property and property which he owns as the vygodopriobretayushchy owner in value of the Law on the prevention and anti-money laundering and financing of terrorism No. 308/2017, of property of the owner and managing director of property which is owned by the suspect, the person accused, the civil defendant, the defendant or the convict as the vygodopriobretayushchy owner, for the purpose of compensation got by criminal way of property;".
2. Add Article 207-1 with Item 6) of the following content:

3. Add the code with Article 207-2 of the following content:
"Article 207-2. Mechanism of use of distrained property
(1) According to Article 207-1 provisions the Agency on compensation of the property got in the criminal way makes to the prosecutor inquiry about giving to the judge on criminal prosecution or the degree of jurisdiction of the petition for use of distrained property considering case and its release from arrest.
