About modification in Criminal, Criminal procedural codes of Ukraine and other legal acts of Ukraine concerning settlement of the procedure of exchange of persons as prisoners of war

The Verkhovna Rada of Ukraine decides:

I. Make changes to such legal acts of Ukraine:

1. The criminal code of Ukraine (2001, Art. No. 25-26, 131) to add sheets of the Verkhovna Rada of Ukraine with Article 84-1 of the following content:

"Article 84-1. Release from serving sentence in connection with adoption by authorized body of the decision on transfer of the convict for exchange as prisoner of war

1. The convict on whom the authorized body makes the decision on its transfer for exchange as the prisoner of war and to which the written consent to carrying out such exchange is this is exempted from serving sentence.

2. If exchange of such convict did not take place, the court according to the petition of the prosecutor makes the decision on the direction of the convict exempted from serving sentence in connection with its transfer for exchange as the prisoner of war, for further serving of the penalty imposed earlier.

3. In case of committing by person, the exempted court in connection with adoption by authorized body of the decision on its transfer for exchange as the prisoner of war and such exchange came from serving sentence, during unexpired part of punishment of new criminal offense the court imposes to it penalty by the rules provided by Articles 71 and 72 of this Code".

2. In the Criminal Procedure Code of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2013, Art. No. No. 9-13, 88):

Part one of Article 3 to add 1) with Item 28 of the following content:

"28) person on whom the authorized body makes the decision on exchange as the prisoner of war, - any person having the procedural status of the suspect, person accused, convict and which is included by the relevant authorized body in the list for exchange as the prisoner of war";

Article 176 to add 2) with part seven of the following content:
