About modification of the Regulations on ensuring compliance with intellectual property rights by customs authorities approved by the Order of the Government No. 915/2016

In the Regulations on ensuring compliance with intellectual property rights by customs authorities approved by the Order of the Government No. 915/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 247-255, 999), to make the following changes:

To add 1) with formula of harmonization of the following content:

"This Provision shifts Article 1 (4) and (5), Article 19, Article 23 and Article 24 (2) (a) Regulations (EU) No. 608/2013 of the European Parliament and Council of June 12, 2013 about ensuring compliance with intellectual property rights by customs authorities and cancellation of Regulations (EU) of Council No. 1383/2003, of the European Union published in the Official magazine of L 181 of June 29, 2013";

2) in all text of the word "statement for customs intervention" and "statement for intervention" in any grammatical form shall be replaced with words "the statement for intervention of customs authority" in the corresponding grammatical form;

3) in Items 13-15, 17-20, 36 and 37 of the word "Customs Service" in any grammatical form shall be replaced with words "central office of Customs Service" in the corresponding grammatical form, and in the subitem c) of Item 60, Item 61, the subitem 3) of Item 64, in appendix No. 6 and in Item 2 of appendix No. 7 to replace the word "receiver" in any grammatical form with the word "beneficiary" in the corresponding grammatical form;

4) in Item of 1 change concern only the text in state language;

To exclude 5) in Item 2 of the word of "this provision";

Item 3 to state 6) in the following edition:

"3. Requirements of this provision are not applied to:

1) to the goods which are object of the protected intellectual property rights and which were made with the consent of the owner, but are without its consent in one of the situations specified in Item 1;
