About modification of some regulations

The Parliament adopts this organic law.

Art. I. - In the Labor code of the Republic of Moldova No. 154/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 159-162, 648), with subsequent changes, to make the following changes:

1. Add Article 33 with part (5-1) following contents:

"(5-1) in case of initiation of the procedure of insolvency of the company the collective employment contract signed before initiation of this procedure keeps the action during the entire period of its action. Change, amendment of the current agreement or the conclusion of the new collective agreement at the company which is in process of insolvency is made only in the consent of the parties.".

2. Part (Article 34 to state 2) in the following edition:

"(2) Any change or amendment of the collective employment contract is brought by the employer to the attention of employees of the company within five working days from the date of introduction by means of:

a) the announcement sent by e-mail or other means of communication, access to which each worker can get; and/or

b) the public announcement placed on the web page of the company, when applicable; and/or

c) the public announcement placed at the public information stand in the company location, including in all its branches or representations.".

3. Part (Article 48 to add 1) with the following offer: "The obligation on informing person selected for employment, or the worker in case of transfer is considered executed by the employer at the time of agreement signature or the supplementary agreement to the individual employment contract.".

4. Item i) parts (Article 49 to state 1) in the following edition:

"i) work payment terms, including the size of official pay rate or tariff charge, the allowance, award and financial support (in case they are part of wages system of the company), form and payment procedure of the salary, and also frequency of payments;".

5. Add the code with Article 53-1 of the following content:
