About modification of some regulations

Art. I. - In the Law on domestic trade No. 231/2010 (repeated publication: The official monitor of the Republic of Moldova, 2021, Art. No. 230-237, 262), with subsequent changes to make the following changes:

1. Add the law with formula of harmonization of the following content:

"This law partially shifts provisions of the Directive No. 2019/633 of the European Parliament and Council of April 17, 2019 about unfair commercial practicians in the relations between the companies in the agricultural and food supply chain published in the Official magazine of the European Union, L 111 of April 25, 2019.".

2. Recognize Article 21-1 invalid.

3. Add the law with Chapter V-2 of the following content:

"Chapter V-2 Contractual relations between the supplier and the buyer on delivery agricultural and food products

Article 21-14. The scope of application and concepts used for the purposes of this Chapter

(1) the Provisions of this Chapter concerning unfair commercial the practician in case of realization of agricultural and food products are applied:

a) suppliers from category of the microcompanies in relation to any buyer, except for buyers from category of the microcompanies, and also in case of the exceptions provided by part (2);

b) suppliers from category of small enterprises in relation to any buyer, except for buyers from categories of the microcompanies and small enterprises, and also in case of the exceptions provided by part (2);

c) suppliers from category of medium scale enterprises in relation to any buyer, except for buyers from categories of the microcompanies, the small and medium companies, and also in case of the exceptions provided by part (2).

(2) the Provisions of this Chapter concerning unfair commercial the practician in case of realization of agricultural and food products are not applied:

a) to small retail trade, except for case when the income of the small retail businessman from sales for tax period exceeds 1200000 lei;

b) in case of trade in the corporate shops provided by line item of 31 appendices 5, goods of the producer/processor;
