About modification of some legal acts of Ukraine concerning features of production on cases on factual determination of the birth or death of person in the conditions of warlike or emergency state and in temporarily occupied territories
The Verkhovna Rada of Ukraine decides:
I. Make changes to such legal acts of Ukraine:
1. In the Code of civil procedure of Ukraine (The sheet of the Verkhovna Rada of Ukraine, 2017, No. 48, the Art. 436):
Article 317 to state 1) in the following edition:
"Article 317. Features of production on cases on factual determination of the birth or death of person in the territory in which warlike or emergency state, or in temporarily occupied territory of Ukraine is entered
1. The statement for factual determination of the birth of person in the territory in which warlike or emergency state is entered or in temporarily occupied territory of Ukraine, certain that according to the legislation, can be submitted by parents or one of them, their representatives, family members, the guardian, the custodian, person who contains and brings up the child, or other legal representatives of the child in any local court which performs justice, irrespective of the place of residence (stay) of the applicant.
The statement for factual determination of death of person in the territory in which warlike or emergency state is entered or in temporarily occupied territory of Ukraine, certain that according to the legislation, can be submitted by members of the family of the dead, their representatives or other interested persons (if factual determination of death of person influences their rights, obligations or legitimate interests) to any local court of Ukraine performing justice irrespective of the residence (stay) of the applicant.
2. Cases on factual determination of the birth or the death of person in the territory in which warlike or emergency state is entered or in temporarily occupied territory of Ukraine, certain that according to the legislation, are considered instantly from the date of receipt of the corresponding petition.
