About introduction of amendments to the Law of Ukraine "About public purchases" and other legal acts of Ukraine concerning implementation of defense and public purchases for action of legal regime of warlike situation

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About public purchases" (Sheets of the Verkhovna Rada of Ukraine, 2019, No. 45, Art. 289 with subsequent changes) the following changes:

1. In part nine of Article 3 of the word of "warlike or emergency state" shall be replaced with words "emergency state".

2. To add the Section X "Final and transitional provisions" with Items 3-7 and 3-8 of the following content:

"3-7. Determine that for action of legal regime of warlike situation in Ukraine and within 90 days from the date of its termination or cancellation of feature of implementation of purchases of goods, works and services for the customers provided by this Law are determined by the Cabinet of Ministers of Ukraine with ensuring security of such customers from military threats.

3-8. Determine what for action of legal regime of warlike situation in Ukraine in case of implementation by the customer of purchase without use of electronic purchasing system provided that the cost of purchase is equal or exceeds 50 thousand hryvnias, the customer publishes in electronic purchasing system the report on the purchase agreement signed without use of electronic purchasing system no later than in 10 working days from the date of the conclusion of such agreement. Customers can not publish information on the location and/or the location of suppliers (contractors and service providers), and/or the place of delivery of goods, performance of works or rendering services if distribution of such information bears risks for safety of the customer and/or suppliers (contractors and service providers)".

II. Final and transitional provisions

1. This Law becomes effective from the date of, its publication following behind day.
