About modification of the Order of the Government of the Russian Federation of April 30, 2020 No. 629

1. Approve the enclosed changes which are made to the order of the Government of the Russian Federation of April 30, 2020 No. 629 "About approval of Rules of compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of housing construction, and Rules of provision in 2020 to subsidy from the federal budget to ДОМ.РФ joint-stock company in the form of contribution to property of the ДОМ.РФ joint-stock company which is not increasing its authorized capital for compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of housing construction" (The Russian Federation Code, 2020, No. 19, Art. 3006; No. 26, Art. 4101; 2021, No. 3, Art. 588; No. 51, Art. 8880).

2. Determine that concerning the credit agreements signed for the purpose of, stipulated in Item 3(1) Rules of compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of housing construction approved by the resolution specified in Item 1 of this resolution (in the edition operating before the date of entry into force of this resolution), compensation of the half-received income, and also assessment of conformity of the specified credit agreements and the credits issued on their basis to requirements of the specified Rules are not performed.

3. This resolution becomes effective from the date of its official publication.

Rules of compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of housing construction

1. These rules establish conditions and procedure for compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of construction of one or several apartment houses, individual apartment houses in borders of the territory of low-rise housing estate, houses of the blocked building (if the number of such houses makes three and more in the same row), which construction is performed by the builder according to the Federal Law "About Participation in Shared-equity Construction of Apartment Houses and Other Real Estate Objects and about Modification of Some Legal Acts of the Russian Federation" (further respectively - the Federal Law, the project of housing construction), and also in other purposes connected with projects implementation of housing construction as they are determined in the subitem "g" of Item 7 of these rules.

2. The half-received income is compensated to credit institutions under agreements on loan granting (further - the credit agreement) on the purpose of projects implementation of housing construction, and also in other purposes connected with projects implementation of housing construction as they are determined in the subitem "g" of Item 7 of these rules, information on which is provided to ДОМ.РФ joint-stock company (further - society) in terms and by form which are determined by these rules, within the funds allocated to society from the federal budget and (or) determined by the Government of the Russian Federation of other sources.

Compensation of the half-received income according to the credit agreements specified in the paragraph the second Item 3 of these rules is performed within the limits of funds for compensation set by the Interdepartmental commission on decision making about compensation to credit institutions of the half-received income on the credits issued for the purpose of projects implementation of housing construction (further - the Commission), according to Item 10 of these rules.

Compensation of the half-received income according to the credit agreements specified in paragraphs three and the fourth Item 3 of the these rules which arose during the period till December 31, 2023 (inclusive) according to these rules is performed at the expense of amount of the funds allocated to society for the purposes of compensation of the half-received income according to the specified credit agreements (further - amount of means), information on which is sent to the Ministry of Finance of the Russian Federation by the Ministry of Construction and Housing and Communal Services of the Russian Federation.

The amount of means is subject to distribution between credit institutions proceeding from the forecast amount of compensation of the half-received income during the entire period of subsidizing according to the procedure, provided by Items 12 and 13 of these rules, and is transferred into the personal accounts of credit institutions opened in territorial authorities of the Federal Treasury according to Item 16 of these rules.

3. According to these rules the half-received income is compensated to credit institutions proceeding from the general size of debt on the credit agreements signed with credit institutions to which the limit of funds for compensation is set and (or) on which part of amount of means, by the following types of credit agreements is distributed:

according to the credit agreements signed for the purpose of project implementation of the housing construction which is low-marginal according to Item 5 of these rules;

according to the credit agreements (including taking into account supplementary agreements about reduction of provisions of the credit agreement in compliance to these rules) concluded for the purpose of housing construction according to the Federal Law;

according to the credit agreements (including taking into account supplementary agreements about reduction of provisions of the credit agreement in compliance to these rules) concluded in other purposes connected with projects implementation of housing construction, not specified in paragraphs second and third this Item.

Conditions of the credit agreements specified in this Item can provide, repayment (refinancing) of the credits (loans) issued by other organizations on the purposes provided by these rules.
