About additional measures for state regulation of the prices and rates for services of enterprise monopolists

For the purpose of stabilization of situation in domestic markets of the republic and based on the Presidential decree of the Republic of Kazakhstan of December 18, 1995 No. 2688, of the valid constitutional law, "About the Government of the Republic of Kazakhstan", the Government of the Republic of Kazakhstan decides:

1. Enter state regulation of the prices of production and supply with heat energy, the services in gas supply, electric utility service, water supply, operation of access railway tracks rendered by the business entities holding dominant position in the markets and using it for unreasonable price increase and rates.

2. Determine that:

1) price information on the goods (works, services) realized in the territory of the Republic of Kazakhstan shall be represented to consumers to tenge;

2) in case of the conclusion of contracts between residents of the Republic of Kazakhstan of the price are established only in tenge;

3) in the absence of metering devices of utilities the amount of payment for gas supply, electric utility service, water supply, heat supply is determined proceeding from the existing rules of consumption which are not exceeding regulation as of January 1, 2003;

4) for the purpose of non-admission of interruption in electricity supply and gas of the regions which are buying the electric power and gas outside the Republic of Kazakhstan and not having possibility of alternative deliveries from the Kazakhstan producers, change of rates for gas and the electric power for consumers can monthly be performed, proceeding from dynamics of the average stock exchange rate of US dollar in month, according to the procedure, established by Agency of the Republic of Kazakhstan on regulation of natural monopolies and protection of the competition.

3. The restrictions set in subitems 1) and 2) of Item 2 of this resolution do not extend to the prices established on services of the organizations in cases, stipulated by the legislation on regulation of natural monopolies and international treaties which participant is the Republic of Kazakhstan.
