About introduction of amendments to the Law on Prosecutor's office No. 3/2016

The Parliament adopts this organic law.

Art. I. - In the Law on Prosecutor's office No. 3/2016 (Official monitor of the Republic of Moldova, 2016, Art. No. 69-77, 113), with subsequent changes, to make the following changes:

1. In Article 17:

in part (16) the last offer to exclude;

add Article with part (17) the following content:

"(17) Temporary fulfillment of duties of the Attorney-General stops by right in case of position assignment of the new Attorney-General or in case of the termination of suspension of powers of the Attorney-General concerning which criminal prosecution was initiated earlier. In case of temporary fulfillment of duties owing to formation of vacancy of position of the Attorney-General the new Attorney-General is appointed not later than in six months from the date of formation of vacancy of position of the Attorney-General.".

2. In Article 18:

part (to state 4) in the following edition:

"(4) Powers of the deputy attorney general come to the end along with powers of the Attorney-General, however the deputy continues to fulfill the duties before appointment of the deputy new Attorney-General.";

add Article with part (4-1) following of content:

"(4-1) in case of suspension of powers of the Attorney-General in connection with excitement of criminal prosecution the Supreme council of prosecutors makes on it the resolution the decision on suspension of powers of deputy attorneys general. Suspension of powers of the deputy attorney general stops along with suspension of powers of the Attorney-General. If powers of the deputy attorney general are not suspended, he cannot interpose in the criminal case concerning the Attorney-General whose powers are suspended, and also in any case which is in production or is considered by the prosecutor appointed by the Supreme council of prosecutors for implementation of criminal prosecution concerning the Attorney-General whose powers are suspended.".

3. Add the law with Article 25-2 of the following content:

"Article 25-2. Position assignment of deputy chief prosecutors of specialized prosecutor's office
