About approval of the List of the fresh fruit and vegetables which are subject to control of compliance to quality requirements for fresh fruit and vegetables and about modification of the Order of the Government No. 929/2009 about approval "Quality requirements and trade for fresh fruit and vegetables"

Based on article 1 of the Law No. 237/2018 on control of compliance to quality requirements for fresh fruit and vegetables (The official monitor of the Republic of Moldova, 2018, Art. No. 486-498, 813) DECIDES: the Government

1. Approve the List of the fresh fruit and vegetables which are subject to control of compliance to quality requirements for fresh fruit and vegetables it (is applied).

2. In the Order of the Government No. 929/2009 about approval "Quality requirements and trade for fresh fruit and vegetables" (Official monitor of the Republic of Moldova, 2010, Art. No. 5-7, 26), with subsequent changes, to make the following changes:

Formula of acceptance to state 1) in the following edition:

"Based on part (1) article 8 of the Law No. 306/2018 on safety of foodstuff (The official monitor of the Republic of Moldova, 2019, Art. No. 59-65, 120), with subsequent changes, and Item g) parts (3) article 11 of the Law No. 237/2018 on control of compliance to quality requirements for fresh fruit and vegetables (The official monitor of the Republic of Moldova, 2018, Art. No. 486-498, 813) DECIDES: the Government"

2) In Requirements:

a) add Item 3 with the text "0701 90; 0703 10; 0703 20; 0704 90 100; 0704 10 000; 0706; 0707 00; 0709 30 000; 0709 93 100; 0807 11 000; 0807 19 000; 0809 10 00; 0809 21 00; 0809 40 05";

b) subitems 1), 3), 6) and 7) of Item 5 to recognize invalid;

c) state Item 6 in the following edition:

"6. By delivery to the market fresh fruit and vegetables shall conform to the minimum requirements to quality and trade, and also sanitary standards.

Compliance of fresh fruit and vegetables to quality requirements and trade can be in addition confirmed with the Certificate of conformity of quality of fresh fruit and vegetables issued according to the Law No. 237/2018 on control of compliance to quality requirements for fresh fruit and vegetables.

Confirmation of conformity of fresh fruit and vegetables to sanitary standards is performed based on the testing which are carried out by accredited laboratory or, in addition, availability of the safety certificate issued according to provisions of article 23 of the Law No. 119/2004 on the means of phytosanitary appointment and means increasing fertility of the soil";

d) in Item 9 the text of "Regulations of legal metrology of RGML 03:2008 "National system of metrology. Packing of products on the weight and amount"" to replace with the text of "The general regulations of legislative metrology on establishment of rules concerning nominal quantities of the packed-up products approved by the Order of the Government 907/2014";

e) state Item 191 in the following edition:

"191. Calibration is made or on diameter of the maximum cross section, or on weight";

f) state Item 193 in the following edition:

"193. For ensuring uniformity of fruits in packet by the size the difference between fruits in the same packaging shall be limited:

1) for the fruits calibrated on diameter:

a) 5 mm - for fruits of category "Extra" and fruits of I and II categories packed by ranks and the blocked layers;

b) 10 mm - for the fruits of the I category laid by embankment in packet or packaging in which they are on sale;

2) for the fruits calibrated on weight:

a) for the fruits of category "Extra", and also I and II categories packed by ranks and the blocked layers:

- 15 g if the weight of the easiest unit constitutes less than 75-100 g;

- 35 g if the weight of the easiest unit constitutes from 100 to 200 g;

- 50 g if the weight of the easiest unit constitutes from 200 to 250 g;

- 80 g if the weight of the easiest unit constitutes more than 250 g;

b) for the fruits of the I category laid by embankment in packet or packaging in which they are on sale:

- 50 g if the weight of the easiest unit constitutes less than 100-200 g;

- 35 g if the weight of the easiest unit constitutes more than 200 g.

3) for the fruits of the II category laid by embankment in packet or packaging in which they are on sale of restriction concerning uniformity by the size is not present";

g) add with Chapters XV-XXVIII of the following content:

"Chapter XV Specific quality requirements and trade for plums

Section 1 Minimum requirements to quality

263. This head establishes quality requirements and trade after preparation and packaging for the following grades of plums:

1) Prunus domestica L subsp. domestica;

2) Prunus domestica subsp. insititia (L.) Schneid;

3) Prunus domestica subsp. italica (Borkh.) Gams;

4) Prunus domestica subsp. syriaca (Borkh.) Janchen;

5) Prunus salicina Lindl;

6) trans-species hybrids, derivatives from plums (Prunus domestica or Prunus salicina) and apricots (Prunus armeniaca) having the signs characteristic of plums.

264. Taking into account the special provisions provided for each category, and the permitted admissions of plum of all categories shall be:

1) whole;

2) high-quality (the products subject to rotting or spoil that does them unsuitable to consumption, are not allowed);

3) net, without visible foreign substances;

4) without wreckers;

5) without damages put with wreckers;

6) without excessive superficial humidity;

7) without foreign smell or smack.

265. Development and stage of maturing of plums shall be such that:

1) to maintain transportation and manipulation;

2) to be delivered in satisfactory condition to the destination.

Section 2 of the Requirement to classification

266. Plums are divided into the following categories:

1) category "Extra" - fruit of this category shall be the extra quality. They shall represent form, characteristic of their version, extent of development and coloring. Fruits shall have dense consistence and to be almost covered with wax raid, characteristic of plums. Products shall not have defects, except for very insignificant superficial defects provided that they do not influence general appearance of product, its quality, safety and trade dress in packaging;

2) the I category - plums of this category shall be high quality. They shall correspond to characteristics of the version, however the following insignificant defects are allowed provided that they do not influence general appearance, quality, safety and trade dress of product in packaging:

a) insignificant defects of form;

b) insignificant defects of development;

c) insignificant defects of coloring;

d) the extent of defects of thin skin of oblong shape shall not exceed in length of 1/3 of the maximum diameter of fruit. In particular, for kinds of Golden Gage the cicatrized cracks can be allowed;

e) other defects of thin skin which total area does not exceed 1/16 general surfaces of fruit;

3) the II category - this category includes discharges which cannot be referred to the highest categories, but correspond to the minimum characteristics stated above. The following defects are allowed provided that plums keep the main characteristics from the point of view of quality, safety and trade dress:

a) defects of form;

b) defects of development;

c) defects of coloring;

d) defects of thin skin which total area does not exceed 1/4 general surfaces of fruit.

Section 3 of the Requirement to calibration

267. Calibration is made on the maximum diameter of cross section (equatorial).

268. For quality category of "Extra" and I category the minimum size constitutes:

1) 35 mm - for large-fruited versions;

2) 28 mm - for other versions;

3) 20 mm - for plums of kinds of Mirabel and discharge home (Damson).

269. For the II quality category the minimum size constitutes:

1) 30 mm - for large-fruited versions;

2) 25 mm - for other versions;

3) 17 mm - for plums of kinds of Mirabel and discharge home (Damson).

270. For category "Extra" the maximum difference between diameters of fruits in one packaging shall not exceed 10 mm.

Section 4 of the Requirement to admissions

271. For the products which are not conforming to requirements of the specified category the following admissions on quality and the size in each packet are established:

1) admissions on quality:

a) for category "Extra" - no more than 5% of quantity or weight of the plums which are not conforming to requirements of this category, but meeting the requirements of the I category or, corresponding to the admissions established for this category. Within this admission of no more 0,5 of % of total quantity of plums can conform to quality requirements for the II category;

b) for the I category - no more than 10% of quantity or weight of the plums which are not conforming to requirements of this category, but meeting the requirements of the II category or corresponding to the admissions established for this category. Within this admission no more than 2% of plums can have cracks or wormholes. Within this admission no more than 1% of total quantity of plums can not conform to any quality requirements;

c) for the II category - no more than 10% of quantity or weight of the plums which are not conforming to requirements of this category or the minimum requirements, except for the fruit subject to rotting or spoil that does them unsuitable to the use. Availability no more than 4% by quantity or weight of fruits with cracks or wormholes is allowed. Within this admission no more than 2% of total quantity of fruits can make the products subject to degradation;

2) admissions by the size - for all categories of 10% of quantity or weight of fruit with variations from the minimum size or the size specified on packaging, the variation shall not exceed 3 mm in the big or smaller party.

Section 5 of the Requirement to representation

272. Content of each packet or batch shall be homogeneous and consist only of products of the same origin, version, quality and the size (in case of calibration).

273. For category "Extra" the requirement of uniformity extends to coloring.

274. Consumer packagings may contain mix of plums of different grades provided that they are homogeneous on quality and for each containing grade - by origin.

275. Visible part of content of packaging shall correspond to content of all packaging.

276. Plums shall be packed so that proper safety of product was ensured.

277. The materials used in packaging shall be new, net and such quality not to cause external or internal injury of product. Use of materials, in particular the paper or labels with the put trade specifications, is allowed provided that when drawing the text or gluing labels non-toxical ink or glue are applied.

278. The labels which are separately pasted on product shall be such that during their removal there was no visible trace of glue left or damages on thin skin.

279. The packet shall contain no foreign substances.

Section 6 of the Requirement to marking

280. On each packet the following data grouped on one party shall be put with the accurate, nonerasable and seen outside font:

1) identification - the packer or the sender: the name and the address, and in case of packaged products the name and the address of the seller can be specified in close connection with indication of "Is packed for" or the similar formulation;

2) nature of product:

a) "plums" and commercial type if content of packaging is not visible outside;

b) name of version or versions (selectively). In case of the consumer packaging containing mix of different kinds of plums - the name of each version containing in packaging;

3) product origin:

a) country of source and, at will, region of cultivation or national, regional or local name;
