About modification of "Rules of maintaining foreign currency transactions by the residents and nonresidents of the Azerbaijan Republic" approved by the Resolution of Board of the Central bank of the Azerbaijan Republic of November 28, 2016 No. 45/1
The board of the Central Bank of the Azerbaijan Republic based on articles 22.0.4 and 22.0.17 of the Law of the Azerbaijan Republic "About the Central Bank of the Azerbaijan Republic" DECIDES:
1. The "Rules of maintaining foreign currency transactions by residents and nonresidents of the Azerbaijan Republic" approved by the resolution of Board of the Central bank of the Azerbaijan Republic of November 28, 2016 No. 45/1 to add with subitem 4.3.5-1 of the following content:
"4.3.5-1. the transfers (guarantee, repayment of damage, compensation and so forth) connected with obligations of legal resident person or - the nonresident at whom more than 50 percent of shares (shares) directly or indirectly belong to the state, before other persons, the obligation fulfillments by the resident executed for the purpose of providing at whom more than 50 percent of shares (shares) directly or indirectly belong to the state and who is shareholder (shareholder) of the specified legal entity. At the same time "state" is meant as the Azerbaijan Republic and such payments are registered with submission to bank of the agreement confirming emergence of the conforming obligation, requirements concerning obligation fulfillment for providing and the documents confirming straight line or indirect share (share) of the state."
2. To legal department (R. Melikov) to charge to provide in three-day time submission of this Resolution to the Ministry of Justice for entering into the State register of legal acts of the Azerbaijan Republic.
