About modification of some legal acts of Ukraine in connection with ratification of the Convention on agreements on the choice of court

The Verkhovna Rada of Ukraine decides:

1. Make changes to such legal acts of Ukraine:

1) Article 366 of the Economic Procedure Code of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with part two of the following content:

"2. In the cases established by the law or the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine cognizance of cases with participation of foreign persons it can be determined by agreement of the parties";

2) Article 497 of the Code of civil procedure of Ukraine (2017, No. 48, the Art. 436) to add sheets of the Verkhovna Rada of Ukraine with part two of the following content:

"2. In the cases established by the law or the international treaty which consent to be bound is provided by the Verkhovna Rada of Ukraine cognizance to courts of Ukraine of civil cases with foreign element it can be determined by agreement of the parties";

3) in the Law of Ukraine "About private international law" (Sheets of the Verkhovna Rada of Ukraine, 2005, No. 32, Art. 422 with subsequent changes):

a) add with Article 4-1 of the following content:

"Article 4-1. Choice of court

1. Participants of the private-law relations with foreign element can sign the agreement on the choice of court which to determine cognizance to courts of certain state to either one or several specific courts of certain state of cases in disputes which arose or can arise between them in connection with such legal relations.

2. The agreement on the choice of court is signed in writing, irrespective of the place of its conclusion. The agreement on the choice of court which elects court of Ukraine consists in writing according to the Law of Ukraine.
