Guarantees of the rights of owners are enshrined in the Constitution of the Republic of Uzbekistan, the Civil code of the Republic of Uzbekistan, the laws of the Republic of Uzbekistan "About procedures of seizure of land for social needs with compensation", "About pledge" and other laws.
According to article 53 of the Constitution of the Republic of Uzbekistan the owner can be dispossessed only in the cases provided by the law and procedure. At the same time the Civil code of the Republic of Uzbekistan allows possibility of the termination of the property right, including in case of withdrawal of property at the owner for social needs, in the cases provided by acts of the legislation. With respect thereto the changes providing the termination of the property right only based on the law are made to the Civil code of the Republic of Uzbekistan.
Besides, based on the Law of the Republic of Uzbekistan "About procedures of seizure of land for social needs with compensation" the change providing protection of the property right of the pledger in case of withdrawal (redemption) of its property for social needs is made to the Law of the Republic of Uzbekistan "About pledge".
This Law will create additional legal terms for ensuring reliable protection of the rights of owners and safety of private property.
