for the purpose of ensuring effective fight against crime in the territory of the Parties, and also implementation of the principle of inevitability of punishment for the committed crime,

being convinced that at this conjuncture coordinated actions of the Parties in fight against crime are the imperative need,

aiming to develop legal basis of interaction of law enforcement and special bodies of both states, agreed as follows:

Article 1.

In this Agreement sense each of below the listed terms has the following value:

"law enforcement and special bodies" - from the Kyrgyz Republic:

- Prosecutor General's Office;

- Ministry of Internal Affairs;

- Ministry of homeland security;

- State Customs Committee;

- State tax authorities of the Ministry of Finance.

from the Republic of Tajikistan:

- Prosecutor General's Office;

- Ministry of safety;

- Ministry of Internal Affairs;

- The Tax Committee under the Government of the Republic of Tajikistan;

- Customs committee under the Government of the Republic of Tajikistan.

"law enforcement and special bodies" - the state bodies which are mutually recognized by the Parties which according to the national legal system perform operational search activities, inquiry and pretrial investigation;

"observation" - the operational search activities directed to establishment of bonds, criminal activities and to search of persons suspected of preparation or making of crimes;

"prosecution" - the action of the employee of law enforcement and special body directed to the detention of the suspect, person accused, defendant or convict performed by land method of movement within border area;

"convoy and convoy of persons detained" the armed convoy and convoy of persons detained on the territory of the states before transfer their to the interested (requesting) Party;
