About modification of the "Rules of hearing of cases about antitrust violations" approved by the Resolution of the Cabinet of Ministers of the Azerbaijan Republic of May 29, 1998 No. 120
Being guided by the eighth paragraph of article 119 of the Constitution of the Azerbaijan Republic, the Cabinet of Ministers of the Azerbaijan Republic DECIDES:
In the "Rules of hearing of cases about antitrust violations" approved by the resolution of the Cabinet of Ministers of the Azerbaijan Republic of May 29, 1998 No. 120 (Collection of the legislation of the Azerbaijan Republic, 1998, No. 5, Article 361; 2001, No. 7, Article 512; 2004, No. 4, Article 287; 2006, No. 5, Article 472; 2009, No. 10, Article 852; 2014, No. 6, Article 736, No. 7, Article 922, No. 12, Article 1676; 2015, No. 7, Article 894; 2016, No. 5, Article 955, No. 11, Article 1960) to make the following changes:
1. add Item 2.21 with the fourth paragraph of the following content:
"If the documents and data provided by the subitem "v" of Item 3.1 of these rules are not provided according to the first or repeated requirement of antimonopoly authority, the antimonopoly authority can address to judicial authorities with the claim for provision of these documents and data.".
2. in the second paragraph of Item 4.1 of the word "in six-months time from the date of their removal" shall be replaced with words "within 30 (thirty) days from the moment of their delivery".
