About introduction of amendments to the Code of Ukraine about administrative offenses concerning strengthening of the administrative responsibility for illegal trade in fuel

The Verkhovna Rada of Ukraine decides:

1. Bring in the Code of Ukraine About administrative offenses (Sheets of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122) the following changes:

Article 21 to exclude 1);

And figures "parts two - the fourth Article 126 and Article 130" shall be replaced with words 2) in the note to Article 22 of the word also in figures "parts two - the fifth Article 126, Articles 130 and 161-1";

To add 3) with Article 161-1 of the following content:

"Article 161-1. Violation of procedure for trade in fuel

Wholesale or retail trade by fuel without state registration by the subject of managing or without receipt of the document of allowing nature if its obtaining is provided by the law (except cases of use of the principle of acquiescence), -

involves imposing of penalty from one thousand to two thousand free minima of the income of citizens with confiscation of fuel, vehicles, reservoirs and the equipment which were used for realization of such fuel, the money received owing to making of this administrative offense.

Other abuses of regulations of trade in fuel, except provided by part one of this Article, -

involve imposing of penalty from five hundred to one thousand free minima of the income of citizens.

The actions provided by part one of this Article, which are commited by person which within year was subjected to administrative punishment for the same offense, or connected with income acquisition in large sizes, -

involve imposing of penalty from two thousand to five thousand free minima of the income of citizens with confiscation of fuel, vehicles, reservoirs and the equipment which were used for realization of such fuel, the money received owing to making of this administrative offense.

Note. Income acquisition in large sizes takes place when its amount of one thousand and more time exceeds free minimum of the income of citizens";
