About introduction of amendments to some orders of the Ministry for Investments and Development of the Republic of Kazakhstan

I ORDER:

1. Bring in the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 198 "About approval of Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 12073) the following changes:

in the Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan approved by the specified order:

state Item 7 in the following edition:

"7. For receipt of the certificate of the flight validity of the civil aircraft the applicant sends to authorized organization through the web portal of "the electronic government" (further – the portal) the request, in form according to appendix 1 to these rules and document package according to the list provided in the list of the main requirements to rendering the state service "Issue of the Certificate of the Flight Validity of the Civil Aircraft" (further – the List of the main requirements to rendering the state service in issue of the certificate of the flight validity) according to appendix 1-1 to these rules.

The inspection statement of technical condition and determination of the validity of the aircraft to flights (further – the inspection statement) represented with document package is drawn up in form, according to appendix 2 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in the List of the main requirements to rendering the state service in issue of the certificate of the flight validity.

In case of the address on the portal, to the applicant the status about acceptance of request for rendering the state service with indication of the date of receipt of result of rendering the state service goes to "personal account".

In case of the address of the applicant after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, registration of the request on rendering the state service is performed the next working afternoon.

Data on identity documents, on state registration (re-registration) of the legal entity, on state registration as the individual entrepreneur, about state registration of the civil aircraft, the air operator certificate, certificate on the right of accomplishment of aviation works, certificates on the right of accomplishment of flights, the authorized organization receives payment confirmation in the budget of collection for certification of the flight validity of the civil aircraft from the corresponding state information systems through lock of "the electronic government".

Reclamation from the applicant of documents which can be received from information systems is not allowed.";

state Item 9 in the following edition:

"9. In case of representation by the applicant on the portal of incomplete document package according to the list provided in the List of the main requirements to rendering the state service in issue of the certificate of the flight validity, and (or) documents with the expired effective period authorized organization refuses acceptance of the request.

In case of representation by the applicant of complete document package, the main requirements to rendering the state service in issue of the certificate of the flight validity provided in the List, the authorized organization checks compliance of the applicant and the provided materials, supplied and the information necessary for rendering the state service to airworthiness standards of the civil aircrafts of the Republic of Kazakhstan approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of March 27, 2015 No. 367 (it is registered in the Register of state registration of regulatory legal acts for No. 12038) (further – airworthiness standards of civil aircrafts of the Republic of Kazakhstan), the Law and to the ICAO aviation standards and performs certified inspection of the flight validity of the aircraft within 10 (ten) working days.";

state Item 9-2 in the following edition:

"9-2. By results of the carried-out works on verification of operational documentation and survey of the aircraft with use of instructive material (according to the program of certified inspection), the authorized organization within 2 (two) working days draws up the appraisal report about serviceability of the civil aircraft (further – the appraisal report) according to appendix 2-1 to these rules which is integral part of the program of certified inspection.

Based on the positive appraisal report, the authorized organization draws up the Certificate of the flight validity according to appendix 3 to these rules or based on the negative appraisal report the motivated answer about refusal in rendering the state service in the bases specified in Item 9 of the List of the main requirements to rendering the state service in issue of the certificate of the flight validity is drawn up.

In case of identification of the bases for refusal in rendering the state service the authorized organization notifies the applicant on the provisional solution about refusal in rendering the state service, and also time, date and the place (method) of carrying out hearing for opportunity to express to the applicant line item according to the provisional solution.

The notification on hearing goes at least in 3 (three) working days prior to completion of term of rendering the state service according to Article 73 of the Administrative procedural Procedure Code of the Republic of Kazakhstan (further – APPK RK). Hearing is carried out no later than 2 (two) working days from the date of the notification.

Following the results of hearing the result of rendering the state service, or motivated refusal in rendering the state service is created.

The result of the state service goes to "personal account" of the applicant on the portal in electronic form signed by the EDS of the authorized person of authorized organization.";

"15. By results of the positive conclusion of check the Certificate of the flight validity or the motivated answer on refusal in rendering the state service according to part two of Item 9-2 of these rules is drawn up.

The result of rendering the state service goes by the method specified in part three of Item 9-2 of these rules.

The authorized organization provides entering of data into information system of monitoring of rendering the state services on stage of rendering the state service "Issue of the Certificate of the Flight Validity of the Civil Aircraft" according to Rules of entering of data into information system of monitoring of rendering the state services about stage of rendering the state service No. 452 approved by the order of the acting minister of transport and communications of the Republic of Kazakhstan of June 14, 2013 (it is registered in the Register of state registration of regulatory legal acts for No. 8555) (further – Rules of entering of data into IS).

The authorized body in the field of civil aviation within three working days after state registration of the order, sends information on the made changes and (or) additions to the these rules determining procedure for rendering the state service, to the operator of information and communication infrastructure of "the electronic government", the service provider and in Single contact center.";

state Item 21-1 in the following edition:

"21-1. For receipt (separate service) of the certificate of the aircraft in noise the applicant sends to authorized organization through the portal the request for receipt of the certificate of the aircraft on noise according to appendix 3-1 to these rules.

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in the list of the main requirements to rendering the state service "Issue of the Certificate of the Aircraft on Noise" (further – the List of the main requirements to rendering the state service in issue of the certificate on noise) in form, according to appendix 3-2 to these rules.";
